CITY COUNCIL MEETING, JANUARY 5, 1982 -7- 10. OLD BUSINESS: D. Personnel Policies - Whittaker will meet with the Personn 1 Commi� ttee snd report. -to the Council January 19. 8. FIRE DEPARTMENT ANNUAL REPORT - BRUCE KUETTNER, CHIEF: Chief Kuettner reported that the new officers for 1982 are: Dick Sachs, Assistant Chief, and Jerome Eder, Bill Eder, Al Kupferschmidt, Fran Pott and Steve Pott, Captains. He reported on the number of fire runs and rescue runs for 1981; and how the EMS funds have been used. As there are only 17 active members, the department:is seeking additional firefighters. Ideal membership would be 30 active members. He also noted that this May the Lake Elmo Volunteer Fire Department will celebrate its 25th Anniversary. Mayor Eder commended the Department on behalf of the c%tizens of Lake Elmo. 11. ADMINISTRATOR'S REPORT: A. Com Plan Review Extension - The Corn c 1 reviewed a letter from the Met Council requesting an extension of the City's Comp Plan Review. Whittaker recommended the extension. M/S/P Mottaz/Eder to approve the extension review of the Lake Elmo Comprehensive Plan until June 30, 1982. B. MSA Variance - As the City was denied reapplication for its MSA variance, Whittaker recommended taking the matter to District Court and request a Writ -of -Mandamus. He will secure a cost and time estimate for Council consideration January 19. C. 'Gun Club Procedures Outline - The Council reviewed the A mdinistrator's Memo -Jan. 4, 1982, Review of Gun Club Regulations and Standards- outlining the steps to be used in developing standards and regulations for gun clubs. Material fromtheNational Guard and the Administrator's data will be discussed January 19. D. Office Appraisal - Whittaker asked the Council to review the appraisal. He will summarize the two options, selling vs leasing for the January 19 meeting. E. Dayton -Hudson Simple Lot\ Division - Whittaker reported there is ho formallydeeded street r-o-w or fee title on this. prnpartyz,)along County 70 (10th St.), as was shown on the survey. The County does have an easement. The City, also, does not have deeded right-of-way for Keats Avenue. The Ordinance does not permit right-of-way to be included in the minimum lot which is 10A in this zone. In discussion with the City Attorney, Planning Commission and County Planning Department, it was determined it would be impossible to get four 10A lots on a typical surveyed 40A parcel. This would also hold true for 40A parcels. The Planning Commission recommended amending the Ordinance to provide for a nominal 10 and a nominal 40 acre parcel to meet the intent of the Ordinance „ and preserve the large lots intended in such zoning districts.
