CITY COUNCIL MEETING, APRIL 6, 1982 <br />-3- <br />5. CIMARRON GOLF COURSE,CUP - Continued <br />Audience Comments:. <br />( --Bruce Wagner - 106 Cimarron - has lived in Cimarron seven <br />years; has had $400 out-of-pocket expenses for broken windows <br />and has no satisfaction from Cimarron management. The proposed <br />netting design will not be adequate. <br />--Stephen Palfe - 134 Cimarron - noted two names on the Olson. <br />petition were out of state at the time the petition went around; <br />and two names were signed before the residents were asked to sign. <br />These residents declined to sign the petition and the names <br />were deleted, This type of action is wrong. <br />Laverne Maehren - 132 Cimarron - lives across from the golf course - <br />likes to sleep later on weekends, but is disturbed by mowing <br />noise at 5 a.m. - balls come into the yard - has had broken <br />window, but, has never turned in a complaint - car has been hit <br />while driving in the park. <br />--Betty Bell - 94 Cimarron - has samecomplaint about noise during <br />the early hours. Why does the grass need cutting each day? <br />--Charles Clausen - 63 Cimarron - main concern is the liability <br />for damage from the golf course - feels there will be continued <br />damage even with the mesh netting - would like the Council to <br />address the damage and see that Mr. Taylor is responsible for it. <br />Does not feel the Olson petition is valid. Has found golf balls <br />in his yard even though he lives a considerable distance from <br />the course. Grass is cut on the ballfield at 5:30 a.m. <br />--Steven Taylor - over the 10 years that the course has been in <br />operation there has been one noise complaint - this was from <br />Stephen Palfe, 134 Cimarron. Questioned Mr. Clausen's claim <br />that he has golf balls from the course in his yard - this would <br />be a distance of 400 yards on a 3-hole course. The petition <br />that was submitted was drafted by Birger Olson, expressing his <br />views and the views of residents around the golf course who <br />had an opinion on the matter. <br />--Mayor Eder - commented on the joint meeting with Cimarron and <br />recommended that the CUP be renewed this year provided: <br />,.1. All mowing be started at the fartherest perimeter of the course. <br />2. Tee 8 be realigned. <br />3. A plan be submitted showing the location of the protective <br />barriers. <br />4. An accurate record of all claims and their disposition be <br />kept with a copy of same sent to the City. <br />5. Mowing of the interior play area be done late in the morning. <br />--Whittaker - explained the noise ordinance and how the City <br />handles checking these levels. <br />--Mottaz - if Cimarron or anyone wants to cut their grass before 7:30 a.m <br />they should prove to the City that they do not exceed the noise <br />level regulation. <br />--Fraser - language on noise should be changed to require compliance <br />with the present ordinance; but language on damage responsibility <br />is appropriate and should remain as written. Believes Cimarron <br />management has the burden of responsibility. <br />
