CITY COUNCIL MEETING, APRIL 6, 1982 <br />-2- <br />5. CIMARRON GOLF COURSE CUP -Continued <br />Mr, Taylor confirmed that the purpose of meeting with the Council <br />was to consider the draft resolution for the golf course CUP. <br />He then addressed the question of noise. <br />--Taylor - 1,000 ft limitation means no :mowing can be done on the <br />course - does not feel the noise problem exists, but, if it does <br />it has been overstated - restriction is not justified and a <br />discrimination is being imposed against Cimarron management <br />beyond the now existing noise ordinance. <br />--Fraser - would support modifying the limitiation to require <br />that the established ordinance be followed. <br />--Taylor - read the public statements,on noise, presented Jan. 19. <br />by Don Moe and Betty Bell, then, referred the Council to Birger <br />Olson's petition from residents adjacent to the course. Do not <br />feel that Mrs. Bell and Mr., Moe represent the people at Cimarron <br />nor are their views representative of the people who live at <br />Cimarron. This has been demonstrated by the Olson petition. <br />Request that the permit be isSu_,d.without the noise provision. <br />--Eder - asked about changes discussed with Mr. Taylor to improve <br />one "T" and the damage claim question. <br />--Taylor - cannot endorse a liability contingency. Proposed the <br />following action for handling damages and requested the Council <br />to endorse such action on a one year trial basis: <br />1. Cimarron will keep accurate records of damages and the <br />disposition of same. Records will be available for Council <br />review at year end. All claims will be considered on an <br />individual basis and pay justified claims. <br />2. Will put up signs on the "T's" of holes that can affect . <br />residences along the holes stating "No Trespassing", that <br />golfers are responsible for damage and if damage is caused <br />it must be reported to the office or the homeowner. <br />3. Barriers will be constructed to prevent damage trees and netting <br />4. Tee $ will be realigned. <br />5. Golf carts will also carry notification of golfers responsibility. <br />A meeting is schedule with the 16-18 homes along the course to <br />discuss the frequency of damage and present preventative alternatives <br />and get th6&r feelings, after which a course of action will be <br />determined. <br />Mr. Taylor answered questions from the audience on handling claims; <br />' definition of a "justified claim Cimarron's liability for damage <br />and damage to vehicles driving: -.within the park <br />Individuals who do not feel they have been properly handled can <br />bring their situation to the Council's attention. <br />AUDIENCE COMMENTS: <br />Don Moe - 61 Cimarron - Does not live on course; but has a ball <br />diamond behind his house that is mowed regularly - during the <br />summer this is mowed anytime --from 5:30 a.m. on. Not awakened <br />from the noise off the golf course; but because of the mowing <br />of the common areas - which is anytime after the golf course is <br />mowed. Noise is not so much muffler noise as is pulling 6r8 mowers <br />behind a tractor - metal on metal noise cannot be muffled. Have <br />an ordinance - hope it is followed. Would have signed the Olson <br />petition the way it is written. Paralled the Councils position <br />on protecting the interests of the people who live around the gun <br />club, including the residents of Cimarron, -on noise control. <br />Request they assume the same postion to .eradicate the noise <br />problem from the golf course for the residents of Cimarron. <br />
