LAKE ELMO CITY COUNCIL MEETING, FEBRUARY 23, 1983 <br />SPECIAL STREET REHABILITATION HEARING <br />Acting Mayor Morgan convened the meeting at 6:32 p.m. <br />Councillors present: Fraser, Dunn and Mazzara. Mayor Eder was absent. <br />AGENDA ITEMS: <br />1. FRANK MEYER - PROPERTY REZONING FROM RR TO AG: <br />Administrator Whittaker reported on the Planning Commission <br />recommendation to approve the never Rezoning in order that Mr. <br />Meyer can qualify for Ag Preserve. He further explained the <br />Ag Preserve Program to new Council members Dunn and Mazzara. <br />M/S/P Mazzara/Fraser adopting Ordinance 7945 rezoning the Frank Meyer <br />property, located at 5055 Keats Avenue, from RR to Aq, per the <br />recommendation of the Planning Commission. Carried 4-0. <br />2. ELIGIBLE AGRICULTURAL PRESERVES LANDS: <br />Whittaker referred the Council to the zoning Map. All property_. <br />zoned Ag, except for Ag/CUP, is eligible for:Ag Preserves. He <br />informed the Council that R-83-24 certifies that lands zoned <br />Ag on the Zoning Map are eligible for Ag. Preserve designation. <br />M/S/P Mazzara/Fraser to adopt R-83-24, A Resolution Certifying <br />Lands Eligible for Agricultural Preserves. Carried 4-0. <br />By this action, the City Administrator has the authority to <br />certify Ag zoned property for Ag Preserves., <br />There being no additional agenda items until the 7:00 Street Rehabilitation <br />Hearing, Acting Mayor Morgan recessed the meeting. <br />Councillor Fraser was excused at 6:50, <br />Acting P4ayor Morgan reconvened the meeting at 7:00 p.m, and opened the <br />public hearing on the proposed Street Rehabilitation Program. Morgan <br />informed the audience that this was a feasibilityr-hearing_to inform <br />residents what is proposed for their areas and that no project has <br />been ordered. He then turned the floor over to Engineer Bohrer for his <br />presentation. <br />Engineer Bohrer used the Feasibility Study book as the basis of his <br />presentation. He recapped the proposed rehabilitation areas and reviewed <br />the problems related to each area. He stated that he did a visual <br />inspection of all the areas, at the request of the City Council, and <br />found various phases of deterioration on all the steets recommended for <br />rehabilitation. He reviewed each area with the proposed improvements <br />and estimated improvement costs. (All this information is documented <br />in the "Feasibility Report for 1983 Street Rehabilitation Program - <br />Commi.ssion No. 7891-01") He then addressed the assessment question. <br />The present plan is to assess the total costs of the project to the <br />property owners. Three methods of assessment were suggested: 1. A <br />front foot charge - property owner would be assessed by the frontage <br />owned on the street; 2. Unit charge - benefitted property owners in <br />each particular area would equally share the total cost; 3. Combined <br />project assessment - all improvement costs for the four areas would be <br />combined and the assessment equally divided among the benefitted property <br />owners. (These proposals are further detailed in the Feasibility Study <br />Book.) <br />
