LAKE ELMO CITY COUNCIL MEETING, MARCH 15, 1983 -7- <br />i 1 <br />6e NELSON/HAGEMAN REZONING; Continued <br />--Tom Loucks - Stated Mr. Nelson ha,s two commitments for single <br />family homes and intends to remodel existing house. Developers <br />fully intend to proceed with the development. <br />Referred the Council to Engineer Bohrers memo of March <br />concerning soil constraints and on -site septic systems. The <br />proposal is predicated on the fact that this is consistent with <br />the Comp Plan and consistent with the Zoning Ordinance requirements. <br />Presented a redesigned layout which provided a 1.8/1.9 acre buffer <br />toathe west,. No lots exit onto 10th Street. Suggested an <br />agreement between the City and the Gun Club to provided sup- <br />plemental plantings in the buffer area for screening and noise <br />reduction. Overall density is 2 acres per lot. Pointed out <br />the wet soils and steep slopes areas and how septic systems <br />and structures would be designed, Reviewed the entire concept <br />plan and noted all the areas of concern previously discussed. <br />Site plan analysis indicates it is feasible to develop this <br />property. The proposal is compatible with the Comp Plan, <br />Zoning Ordinance and the long range intentions of the City. <br />--Eder -- noted that the location of Mr. Hageman's proposed home <br />is such that a decision will ultimately have to be <br />made as to whether the Gun Club could continue to operate <br />in the present location, <br />--Loucks - just asking for rezoning - aware that lot line adjustment <br />may have to be made - cannot work out details until land is rezoned. <br />Councilhas'the'author;ty to determine that the northwest lot <br />is not buildable bacause of nuisance factor created by the Club, <br />--Mazzara - other Councillors may feel the other -three westerly <br />dots create a nuisance. <br />--Loucks - agreed - suggested that the Gun Club might be <br />interested in purchasing them in order to create their own buffer, <br />--Eder, Loucks and Nelson - discussed drainage of the site <br />and lot configurations. Nelson noted that all run-off will <br />remain on -site, <br />Morgan - opposed the rezoning - concerned about the incompatibility <br />of use between the Club and residential property - feels there <br />should be more concern and consideration for the gun range. <br />Small proposed buffer strip is not an adequate buffer between <br />two very distinct uses. <br />--- Dunn - suggested imposing covenants on the Nelson/Hageman land <br />to protect the gun club and make future residents aware of the <br />nuisance they may be subjecting themselves to. <br />-Ray Marshall - difficult to draft covenants until a preliminary <br />plat is submitted. <br />-Dunn - before making any commitment need to get something in <br />writing between the Club and the developers, <br />--Gene Hageman - asked if the rezoning can proceed with covenants <br />and other items addressed at the time of platting, <br />--Rich Redman - Oakdale Gun Club - underlying issue is the relation- <br />ship between the club and the adjacent property. Outlined <br />possible future problems with restrictive covenants, buffer <br />zone, noise abatement. Technical feasibility of the two uses <br />should be proven to the satisfaction of the City prior to <br />rezoning rather than moving this closer to development and <br />later finding it is not feasible. <br />--Loucks - developersdo•_not _want a conditional rezoning. <br />--Morgan - believes the City has defensible reasons for denial - <br />
