LAKE ELMO CITY COUNCIL MEETING, MARCH 15,. 1983 <br />�� <br />6. NELSON/HAGEMAN - Continued: <br />--Morgan - buffer is too small; would subject future residents <br />to a nuisance and a hazard; conflicting uses of land without <br />adequate open or buffered space - the Gun Club has been there <br />for years, good citizens, good neighbors, serve a useful <br />purpose - should not do anything in rezoning adjacent property <br />that would cause them to be considered a nuisance or a menance. <br />Would vote against rezoning because the plan is unacceptable <br />as far as incompatible uses being too close together. <br />M/ Fraser to rezone 23.41 acres in -the south half <br />of the southeast quarter of Section 26, to R-1 from RR for <br />Gene Hageman and David Nelson. <br />Motion failed for lack of second. <br />M/S/P Dunn/Morgan to deny rezoning 23.41 acres in the south half of <br />the southeast quarter of Section 26 for Gene Hageman and David Nelson <br />for the following reasons: <br />1. R-1 (single family residentila) is not compatible with <br />adjacent uses (Regional Par), Reserve, agricultural land, and <br />an outdoor target range). <br />2. There is not an adequate buffer or transition zone between <br />these incompatible uses. <br />3. This would be spot zoning, given present land use. <br />4. Soil conditions on the site may not support R-1 development <br />density. <br />5. Rezoning would place incompatible development next to the <br />Oakdale Gun Club and thereby put the now permitted and long- <br />established facility in the position of becoming a nuisance <br />and a. hazard to adjacent property - where no nuisance or hazard <br />now exists. <br />6. Rezoning would not be consistent with City efforts to meet the <br />requirements of the Metropolitan Council to decrease the amount <br />of expansion of 1 1/2 acre lots outside of existing single-family <br />areas. It would not be in -filling between R-1 areas as we have <br />:been encouraged to permit. It would establish a new area of <br />R-1 away from existing R-1 areas. <br />7. Rural residential zoning is more consistent with present and <br />planned(:uses for adjacent property especially the Regional <br />Park Reserve and the Oakdale Gun Club <br />Discussion: <br />--Fraser - based on the opinion of the City Attorney that from a <br />legal standpoint this is not the legal thing to do and the fact <br />that this action is going to cost the City alot of needless dollarip, <br />will oppose this motion. <br />Motion carried 4-1. Fraser opposed. <br />8. PLANNING COIAU-IISSION REPORT: <br />B. Ordinance 7947 - zoning Map & Zoning Amendments -Mobile Home Code- <br />-- p - - - - <br />WhttaE er re orted-on tie PZC comments and recommendations-- <br />as outlined in their March 14 minutes. <br />--Eder - questioned the number of maintenance employees living in <br />Cimarron. <br />--Mike Ahrens - reported that several employees live on -site. <br />--Fraser - regarding section 302.420 - residents have continually <br />come to the City and,reportedly,to management requesting that <br />an atendant be on the premises at all times and be available. <br />
