Lake Elmo City Council Meeting 2-7-84 Page 2 <br />Dunn stated that he received information that Mr. Marty was not only <br />working the City without a permit, but was also dumping the septic <br />waste on City property. Dunn stated he would like to see Mr. Marty <br />pay all past -due permit fees and legal costs incurred by the City to <br />this point ($306), or face prosecution. <br />Consensus of the Council is that it is the Building Official's <br />responsibility to enforce the rules of the City. <br />B. Other <br />There were no public, inquiries or presentations made. <br />C. "Mom's Day Out" program at Lake Elmo Baptist Church. <br />Carol Oakland, Director of the "Mom's Day Out" program explained the <br />necessity of her request for zoning approval by the Lake Elmo City <br />Council as outlined in her letter of 1-25-84 to the Council. The <br />program is currently set up on a once -a -week basis; Ms Oakland asked <br />that if in the future this was increased to twice a week, would she <br />have to again appear before the Council. <br />Klaers stated that Ms Oakland would not have to appear before the <br />Council again, but would like the City kept informed as to any changes <br />were made. <br />M/S/P Dunn/Fraser - to approve the request of Lake Elmo Baptist <br />Church to operate a one day per week day care center, titled "Mom's <br />Day Out", as the church is located in the proper zone for this type of <br />activity. (Motion carried 4-0) <br />5. Planning Commission Report: <br />A. Application for zoning code amendment: To permit open <br />sales lots for horticultural products, to be used for landscaping, <br />with a CUP in the RR zone. Submitted by Ron Smith. 9999 loth Street <br />Nancy Prince, Chairwoman of the Planning Commission, explained to the <br />Council that the Planning Commission voted in favor of this <br />application (a 9-0 vote) because they felt it was not a bad idea for <br />lots this size (10 acres) being used in this manner throughout the <br />City. Prince further stated that the Planning Commission favored the <br />small businessperson as opposed to larger commercial development. <br />Fraser stated she is reluctant to grant this request based on the <br />discussion among the Planning Commission members; and based on the <br />recommendation from the City Planner that commercial uses of any form <br />should be discouraged from locating in planned residential areas; they <br />should be encouraged to locate in areas that are designed to <br />accomodate them. <br />
