Lake Elmo City Council Meeting 2-7-84 Page 3 <br />Mazzara stated his concerns were that of the traffic problems that <br />could be created if sales lots, such as this, were located throughout <br />the City. <br />Dunn stated that this zoning code amendment would have a great impact <br />on people that don't even know this issue has been brought up. He <br />further stated he could find no justification in this request. <br />Eder stated his concerns were that of the failure of CUP recipients to <br />live up to the promises or agreements that they make when applying for <br />their permits. <br />M/S/P Eder/Dunn - to deny the zoning code amendment to permit open <br />sales lots for horticultural products to be used for landscaping, with <br />a CUP in a RR zone. (Motion carried 4-0) <br />It was the consensus of the Council that along with aforementioned <br />reasons for denial, the recommendation from City Planner, Rob <br />Chelseth; "that the request for amending the zoning code to permit <br />open sales lot for agricultural / horticultural by CUP not be enacted. <br />Instead, applicants should be encouraged to seek land zoned <br />agricultural or general business, or land suitable to be rezoned as <br />such." become a reason for Council denial. <br />B. Developer's Agreement for the 1979 Timmers minor <br />subdivision. <br />Discussion of City Engineer, Larry Bohrer's letter of February 1, <br />1984, wherein he concurs with the Planning Commission's recommendation <br />that the proposed private driveway easement between Parcels A and B is <br />not necessary; that no design standards have been adopted for private <br />roads but have been reviewed on a case -by -case basis. In this case, <br />Bohrer recommends that the private road from Lake Jane Trail to the <br />driveway serving Parcel A be 22 feet in width to allow passage of two <br />vehicles. Beyond that point, the road will function as a single <br />driveway and a 12 foot width should be sufficient. The road should be <br />surfaced with 6 inches of gravel and have shallow side ditches for <br />drainage. The slope from the edge of road to the ditch should not be <br />steeper than 3 feet horizontal for each 1 foot drop in elevation. <br />Disturbed areas should be seeded and established so there is no <br />evidence of erosion; and since Washingon County Soil Survey indicates <br />that Parcels A and B have limitations for septic systems due to steep <br />slopes or wet soils, Bohrer recommends that Timmers show by means of <br />soil borings and percolations tests that Parcels A and B have <br />sufficient area for primary and secondary drainfields as per Code. <br />This will determine the "buildability" of those parcels. <br />M/S/P Eder/Fraser - to approve the Timmers Development Agreement <br />sustaining the recommendation of the Planning Commission and City <br />Engineer,as outlined in his letter of February 1, 1984; and subject to <br />Park Donation of $175 per lot.
