LAKE ELMO CITY COUNCIL MINUTES 5-15-84 PAGE 4 <br />Dunn stated his concern was if the City approved the mound system, and <br />the system fails, would the City be legally responsible. <br />Engineer stated that percolation tests have to be done. If the <br />percolation rates would not be adequate, there are no other <br />alternatives. <br />Consensus of the Council is that the adjacent property owners should <br />be made aware of this proposal and this particular situation warrants <br />a public hearing. <br />Bohrer stated that there is a three home joint septic system proposed <br />for this immediate area under the 201 Program, and the possibility <br />exists that this septic system could be accomodated by this joint <br />septic system. <br />Fraser stated that if the 201 Program is intended to deal with <br />existing problems, on that basis it should not be used to handle a new <br />situation. <br />Eder stated that even if some of the variances were approved, the <br />septic system still has to be ten feet away from a property line. <br />Bohrer suggested that since the percolation tests have to be taken <br />anyway, they may decide in themselves that this is not a buildable <br />lot. <br />Fraser stated that even with favorable percolation tests, she would <br />find it very difficult to vote in favor of this application. <br />Dunn stated that before he made a decision, he would like to hear the <br />Engineer's recommendations on the septic system based on the <br />percolation test. <br />M/S/P Fraser/Dunn - To table a decision on this application until the <br />results of the percolation test are submitted. (Motion carried 4-0) <br />E. Bid review for 1984 MSA Project and review <br />right-of-way appraisals. <br />Engineer reviewed the bids that were opened on May 9, 1984 for work on <br />the 1984 MSA Project and Jane Road North within Krause's Addition. <br />The low bid was submitted by Forest Lake Contracting for $163,683.26 <br />(1984 MSA Project $142,876.76 - Jane Road North $19,806.50). Engineer <br />stated that these projects are within his estimates and recommended <br />that the contract be awarded to the low bidder. He further <br />recommended that the award be delayed until plan approval is received <br />from the State Aid Division of MnDOT. This plan approval is expected <br />to be received by June 5, 1984. <br />Engineer pointed out that these bids are construction costs and in the <br />total cost of a project, there are other things considered; ie: <br />engineering costs, etc., that will be added. <br />Engineer further advised the Council that per their instructions, an <br />estimate for completing the surfacing on Jamaca Avenue north of Jane <br />Road was done and the estimated total cost for this work is $6,060.00. <br />
