Public Hearing Application by Jed Wier for two zoning <br />code variances to allow the construction of an accessory <br />structure before the primary structure; and to allow the <br />accessory structure to exceed the code required maximum <br />of 2000 square feet on the newly created 17 acre lot <br />approved by the Council in 1983. <br />Pursuant to published notice, this public hearing was opened at 8.30 <br />p.m. in the Council chambers. <br />The Council reviewed the reports submitted by Building Official and <br />City Planner. City Planner pointed out that a variance should be used <br />to relieve unique hardship situations not created by actions of the <br />applicant and that it would appear from the application that this <br />request has difficulty meeting these criteria used in deciding to <br />grant a variance. <br />Fraser stated that she is opposed to this as the present code was <br />adopted to prevent the very thing that this application requests. <br />Eder concurrs with Fraser and added that this would set an undesirable <br />precedent. <br />Neil Kreiger, an adjacent property owner, stated he was not concerned <br />with the size of the building, but is concerned with the visual <br />aspect. <br />The public hearing was closed at 8:40 p.m. <br />M/S/P Fraser/Dunn - To deny the request by Mr. Wier for two zoning <br />code variances to allow the construction of an accessory structure <br />before the primary structure; and to allow the accessory structure to <br />exceed the code required maximum of 2000 square feet. (Motion carried <br />3-1 <Mazzara>). <br />H. Other <br />1. Request by an attorney for Mr. Beaubien to <br />drill test well(s) in Sunfish Park. <br />Engineer advised the Council that Beaubien's have hired a consultant <br />by the name of Fletcher Driscoll. He is a professor at the University <br />of Wisconsin, and was hired by the Beaubien's to give them some <br />information on the ground water situation between City Park Pond and <br />Sunfish Lake. He would like to conduct the drilling on the City <br />property (Sunfish Lake Park) in the valley that runs between the park <br />pond and Sunfish Lake. Bohrer said that he conferred with City <br />Attorney who advised him that we have no basis to deny this request as <br />long as he performs the tests in a reasonable manner. <br />Fraser suggested getting this request in writing, outlining <br />specifically what the drilling will consist of and how the area will <br />be cleaned up after drilling is complete. <br />
