LAKE ELMO CITY COUNCIL MINUTES JUNE 19, 1984 PAGE 8 <br />alternate would be 30 feet where 75 feet is required. Both primary <br />and alternate systems can meet the required building elevation. The <br />Engineer further recommended that if the Council views this <br />application favorably, one variance would be required for septic <br />system setback from the high flood mark. The degree of variance would <br />be determined by which elevation was used for the high flood. He <br />feels the VBWD elevation of 891 to be more accurate. <br />The Engineer further indicated the the platted lot size exceeds 1.5 <br />acres and the area above the OHW mark is .96 acres. The application <br />understated the drainfield area required. A three bedroom home of 9 <br />mpi average pert rate will require 600 gal x 1.27 SF/gal = Sf of <br />treatment area; or 254 LF of trench. All other requirements of the <br />Shoreland Regulations and Septic System Ordinance can be met. <br />The DNR made no objection to this application. <br />M/S/P Fraser/Morgan - To approve the Shoreland Permit and septic <br />system variance setback from the OHM for Mr. Kromschroeder on Lot 2, <br />Block 1 Ruth's 1st Addition for the construction of a new home <br />contingent upon the applicant complying with City Engineer's <br />recommendation in his letter of June 14, 1984. (Motion carried 5-0) <br />H. Application for a shoreland permit and variance for the <br />construction of a house on lot 6, Krause's Addition by <br />David Krause. <br />The City Engineer reviewed his letter of June 14, 1984 in which he <br />addresses (1) Lot size - the platted area consists of .92 acres of <br />which .78 acres is above the OHW mark where 1.5 acres are required. <br />Since the platted lot size exceeds 60% of that required, a variance <br />from the zoning code is not required. This was a pre-existing lot <br />prior to the adoption of the Shoreland Ordinance and no additional <br />land is available. (2) Structure Setback from Water - The house is <br />proposed to be a minimum of 80 feet from the OHW mark (elev. 924) <br />where 100 feet is required. The house is proposed to be somewhat <br />closer to the water than the neighboring houses because the septic <br />system is on the road side of the lot, not the lake side. A deck is <br />also shown as optional and being 50 feet from the OHW mark where 100 <br />feet is required. All other conditions of the Shoreland and Septic <br />System Ordinances can be met. <br />The Engineer recommended that the deck be located where it would not <br />require a variance. Mr. Krause stated that he changed his plans and <br />the deck will be located on the east side of the house. <br />M/S/P Morgan/Dunn - To approve the Shoreland Permit and lot size and <br />structure setback variances for David Krause at Lot 6, Krause's <br />Addition contingent upon applicant complying with recommendations of <br />the City Engineer in his letter of June 14, 1984.
