LAKE ELMO CITY COUNCIL MINUTES JULY 17, 1984 PAGE 5 <br />Regarding the necessity of any upgrading that would be needed for the <br />entrance from Highway 36, Mr. Bergmann stated that he spoke with the <br />State and they stated they would put an extension on the culvert so <br />there would be a more even traffic flow. <br />It was pointed out that what Mr. Bergmann proposes is allowable in the <br />Ag zone with a CUP (Section 301.070 of the City Code); and other <br />applications that the Council has heard (and denied) in the past were <br />not allowable in the zoning district of those applicants. <br />Mr. and Mrs. Al Bergmann stated they too own land in this area and <br />wanted to know why their requests for road access to Highway 36 has not <br />been given consideration. The Council stated that access to Highway 36 <br />is a Mn/DOT issue and not a City issue. <br />The Council advised the Bergmann's to consult with the City <br />Administrator as to what could be done with their land that abuts <br />Richard Bergmann's land. <br />The public hearing was closed at 8:50 p.m. <br />M/S/P Morgan/Dunn - To adopt resolution 84-43 for an amendment <br />(expansion) for an existing CUP; and side yard setback (50 feet setback <br />rather than the required 100 foot setback) at Lake Elmo Avenue and <br />Highway 36 for Richard Bergmann. (Motion carried 5-0). <br />F. Public Hearing for application by John Taylor for a zoning rear <br />yard variance for the construction of a garage at 8801 37th Street <br />North. <br />This agenda item has been deleted from the City Council agenda. The <br />staff initially believed that a variance was required for this <br />application. Upon further review it was determined that the accessory <br />structure meets the side and rear setback requirements. Notice was <br />published in the official City newspaper. No Council action is needed <br />on this application. A revised notice has been sent to the two property <br />owners that were affected by this application. A report from the <br />Building Official was handed out to the Council explaining that this <br />application did not require a variance or City Council action. No City <br />Council action is needed or being requested for this item. <br />G. Other. <br />(a) Update on 201 Program <br />The City Engineer reviewed his plans to hold an open -house for those <br />residents that are participating in the 201 Program. His suggestion is <br />to have the first open house on Saturday, July 28, 1984 from 10:00 a.m. <br />until 4:00 p.m. for those residents in the Tri-Lakes and Jamley Avenue <br />areas. The Engineer will send out the notices to the residents involved <br />in this program. Information will be available in the City Council <br />chambers for viewing. <br />
