LAKE ELMO CITY COUNCIL MINUTES APPROVED BY CITY COUNC� <br />JULY 3, 1984 7-17-84 <br />The meeting was called to order by Mayor Eder at 7:00 p.m. in the <br />Council Chambers. Present: Dunn, Fraser, Mazzara, Morgan, <br />Administrator Klaers, City Engineer Bohrer. <br />1. Agenda <br />M/S/P Morgan/Dunn - To approve the agenda as amended: delete 8A - <br />Comparable'Worth Proposal; Add 8E - Announcements. (Motion carried <br />5-0) <br />2. Minutes - June 19, 1984 <br />M/S/P Morgan/Mazzara - To approve the minutes as amended. (Motion <br />carried 5-0). <br />3. Claims Dunn/Morgan - To approve claims 85000 thru 85034. (Motion <br />carried 5-0). <br />M/S/P/ Dunn/Morgan - To approve one addition to the claims list. ($15 <br />payable to Mary Meyer for publication of the DNR restriction notice in <br />the newspaper). (Motion carried 5-0). <br />4. Licenses: 3.2 beer license at Green Acres Recreation Center <br />M/S/P Dunn/Morgan - To approve a one day 3.2 beer licenses for Valley <br />Dental Arts, Inc. on July 14, 1984; Iowa Park Industries on July 21, <br />1984; Schroeder Milk Company on July 22, 1984. (Motion carried 5-0) <br />5. Public Inquiries (None) <br />6. Engineer's Report <br />A. Simple lot subdivision and variance for Howard Springborn <br />at lot 9, block 2, Green Acres Addition. <br />This application was tabled at the June 19, 1984 meeting for an opinion <br />from the City Engineer on the validity of the 1978 Conepet Plan which <br />was approved by the City Council. The Attorney stated his opinion is <br />that the City's approvel in 1978 of the Concept Plan for this <br />development is binding. The Attorney believes the developer has a <br />strong argument that they would suffer great economic damage in the <br />event they had to reapply at this point and be treated as a new <br />development. Part of the justification and rationale behind concept <br />approval is that the City is better able to plan for and anticipate <br />future development before it occurs. The Attorney further stated that <br />the applicant has the right to rely on the City's prior approval in <br />1978 and thinks if the matter were litigated, the City would be bound <br />by the prior approval. <br />
