WITNESSES: <br />1. Purpose. The Developers have made application to the <br />city for approval of a land development known as Trot 1, Block 1, <br />Teal Pass Estates, Second Addition, withi❑ the corporate limits <br />of the City described as follows: <br />See attached Exhibit "A" <br />(hereinafter referred to as the "Development"). The City <br />Council on September 4, 1984, approved the final plat- by adopt- <br />ing Resolution 84-, on condition that Developers enter into this <br />Agreement to provide for the installation of streets and other <br />improvements on the terms and conditions of the Ci.ty's prelimi- <br />nary approval and in consideration of the mutual promises and <br />conditions hereinafter contained, the parties hereto agree with <br />each other as set forth in the following paragraphs. <br />2. Required Improvements. In accordance with the policies <br />and ordinances of the City, the following -described improvements <br />shall be constructed and installed on the terms and conditions <br />hereinafter contained: <br />(a) Street grading, graveling and stabilizing, <br />bituminous surfacing, bituminous curb, con- <br />struction of berms and boulevards, and turf <br />restoration, including seeding and mulching <br />and street signs (hereinafter called "street <br />improvements"); <br />(b) Drainage improvements, if any, to the extent <br />determined to be necessary by the City En- <br />gineer, including all necessary catch ba- <br />sins, ponds, inlets, and other appurtenances <br />including an overflow pipe and structure <br />(hereinafter called "drainage improve- <br />ments"); <br />(c) Underground gas, if any, electric and <br />telephone service to be arranged by <br />D e v e l o p e r s w i t h u t i l i t y c o m p a n i e s <br />(hereinafter called "utility improvements"). <br />-2- <br />
