( 3. Dcsifn, Inspection and As-Builts and Warranty Related to <br />Improvements. The construction plans and specifications for all <br />drainage improvements and street improvement's have been prepared <br />by a registered professional civil engineer and approved by the <br />City Engineer and the City Council and Developers through their <br />engineers shall provide for competent daily inspection of all <br />street and utility construction, both public and private. <br />As -built drawings with service and valve ties, in a form <br />acceptable to the City Engineer, together with certificates of <br />completion and compliance with the approved specifications, <br />shall also be delivered to the City Engineer. <br />Prior to acceptance by the City of any streets or utilities <br />or commencement of maintenance thereof, the City Engineer shall <br />i <br />inspect and approve the same and signify his approval for ac- <br />ceptance in writing. <br />Developers by this instrument, agree to a one (1) year war- <br />ranty from and after approval by the City Engineer, in favor of <br />the City covering the workmanship and material in such street <br />and utility improvement. <br />4. Time for Performance_ Completion by City on Default. <br />Developers agree to complete the improvements required by this <br />Agreement on or before October 1, 1985. <br />In the event Developers fail to compute the said improve - <br />meats within the time provided by this Agreement, then the City <br />may at its option bring an action in a court of competent juris- <br />diction for an order compelling Developers to complete the im- <br />provements or cause the same to be completed in which case the <br />-3- <br />
