MEMO <br />DECEMBER 28, 1983 <br />T0: MAYOR AND COUNCIL MEMBERS <br />FROM: PAT KLAERS, CITY ADMINISTRATOR <br />SUBJECT: INFORMATIONAL MATERIAL FOR CITY COUNCIL <br />MINUTES: <br />Attached is a draft of the minutes from the November 21, 1983 <br />Park Commission Meeting. <br />OTHER MATERIAL: <br />1. Attached is our certification that Lake Elmo is a member of <br />good standing in the Minnesota Association of Civil Defense. <br />2. Attached are two letters regarding the permit obtained by <br />Washington County from the Minnesota Pollution Control <br />Agency to operate a Gradient Control Well System. One of <br />these letters is from the engineering firm hired by the <br />County; and the other is from Bob Lockyear of Washington <br />j County. The intent of these letters is to keep Lake Elmo <br />t informed on what is happening at the landfill site. Please <br />note that this permit is good thru September 30, 1988. <br />3. The most recent City Newsletter dated December 13, 1983, is <br />attached. As you can see, Mary Meyer had a wealth of infor- <br />mation for this last issue of 1983. Therefore, Mary put <br />together a two page newsletter, which also gave her the <br />opportunity to print some articles that have been previously <br />planned, but never quite made it into a Newsletter issue. I <br />am especially happy to see the snowplowing schedule outlined <br />in this newsletter. <br />4. This week I called Sally A. Johnson, of Faegre & Benson, who <br />represents the City in the LaVonne Richert and the Weldon <br />Richert vs the City of Lake Elmo lawsuits for an update on <br />these lawsuits. She indicated to me that nothing new has <br />taken place and that nothing else is expected to take place <br />for a few months. Currently, the MN PCA has been dismissed <br />from the Weldon Richert suit and has requested to also be <br />dismissed from the LaVonne Richert suit. According to Ms. <br />Johnson, the reason for this dismissal by the judge and sub- <br />sequent second request for dismissal is based on the <br />"exercise of judgement" used by the PCA. Ms. Johnson <br />further indicated that the City also had to use the <br />"exercise of judgement" in approving the building permit <br />and, therefore, will also be seeking dismissal from the law- <br />suits (once the PCA is out of the cases) based on the same <br />reasoning as the PCA. <br />
