Therefore, somebody was anticipating this problem, <br />and made provisions to run this water down to the Nippolt property. <br />M/S/P Morgan/Armstrong - to instruct the City Engineer to write a <br />letter to the MPCA, Washington County and Ramsey County expressing <br />the concerns of Lake Elmo with this runoff; that arrangements should <br />be made to reimburse Mr. Nippolt for the damage that has been caused <br />to his property; to do whatever is necessary to keep the water on the <br />landfill property as per the assurances previously given to the City; <br />and that Lake Elmo is concerned with the potential danger of this <br />pond and ice pile. (Motion carried 5-0) <br />D. Discussion: VBWD 509 Plan <br />The Engineer referenced his memo "Review of Draft 509 Plan Dated <br />January, 1985 Reviewed February 18, 1985" hereby made part of these <br />minutes (Exhibits ]. thru 5). The Engineer reviewed step by step the <br />fourteen recommendations he deemed significant to the City of Lake <br />Elmo to be incorporated into the 509 Plan by the Board of Managers <br />(included in this memo). The Engineer further stated that this review <br />is in preparation for the 2-21-85 VBWD public meeting for all <br />officials of the cities and townships within the district. Written <br />comments will be received by VBWD up until March 15, 1985. <br />The City Engineer and City Administrator will attend this 2-21-85 VBWD <br />meeting and verbally express the concerns as outlined in this memo, <br />with the exception of #12 relating to Cost Estimates. <br />7. City Council Reports <br />A. Update on 2-9-85 conference for newly elected officials. <br />Three City Council members (Rose Armstrong, Arlyn Christ and Mike <br />Mazzara) attended this conference put on by the League of Minnesota <br />Cities. They felt the conference was interesting and offered handouts <br />to be copied for those interested. They would also recommend this <br />conference for future elected officials. <br />B. Cross Country Ski Race <br />Arlyn Christ presented the council members with pins commemorative of <br />this ski race held at Sunfish Park on February 16th and as a thank you <br />for allowing the Jaycee's to use the facility for this race. Christ <br />stated there were about sixty-five participants in this race. The <br />winner of the race was Dan O'Donnel who finished the 11 kilometer race <br />in forty minutes. <br />C. Sunfish Lake - Morgan (update) <br />Morgan stated that the Sunfish group has indicated they will commence <br />a lawsuit if pumping continues into City Park Pond. Lake Jane <br />obviously will have some homes going under if the pumping is stopped. <br />Therefore, there is going to be a problem either on Lake Jane or at <br />Sunfish Lake. It does look like the amount of water that needs to be <br />taken out of Sunfish to keep it from rising could be irrigated on City <br />owned land. The problem is that we have to go through the petition <br />and hearing process to do that. The cost of the project would be <br />between $28,000 and $33,000, which could be assessed back upstream. <br />However, the existing 1005 Project does not give us jurisdiction to <br />
