ASSESSMENT HEARING MINUTES SEPTE.MBER 10, 1985 Page 2 <br />acre lots on the south, but only three lots of 10 acres or more on <br />the north because of the curve which takes up a certain amount of <br />property. <br />Mike Mazzara asked how does land in Green Acres affect the <br />assessment. Bohrer answered that the assessments are deferred <br />until such time as the land is sold or the use changes. Interest <br />does accrue. <br />Wynn John, 8883 Jane Rd. N., stated that the road is a definite <br />improvement from what we had before, but that the turnaround has <br />inadequate space. <br />Jim Weyer, 8991 Jane Rd. N. thanks the Council for keeping this <br />well within the budget and for this proposal of a 22 foot wide <br />road. He would prefer 10 years at the 10% interest rate. <br />The City Engineer discussed the installment payments of 10 and 12 <br />percent over a five and ten year period, but City Attorney Knaak <br />enlighted the Council that if the City pays for it out of existing <br />funds you are limited to an 8% interest charge. <br />The total amount of the assessment may be paid to the City of Lake <br />Elmo prior to October 10, 1985. If not paid before October 10, <br />1985 the assessment will be certified to the Washington County <br />Auditor in ten (10) equal installments, with interest accruing on <br />the unpaid balance from January 1, 1986 at the rate of 8% per <br />year. <br />Councilman Dunn acknowledged a letter from Airs:-Bersehens; Mrs. <br />Frances Eder, Joseph F. Moris, Jr. and Donald Moris through their <br />Attorneys Lawson, Raleigh, & Marshall dated September 3, 1985 to <br />the City of Lake ELmo objecting to any assessments of their <br />property for the improvemnns referred to in the Notice. <br />M/S/P Dunn/Armstrong - to accept the assessment of 8% interest for <br />10 years as proposed by the City Engineer for 45th St, Julep <br />Avenue and 47th Street and Jane Road North. (Motion carried 4-0). <br />M/S/P Christ/Mazzara - to adopt Resolution 85-30 to assess the <br />property owners in the approved assessment roster as presented by <br />City Engineer Bohrer for 45th Street, Julep Avenue and 47th Street <br />(Exhibit A as attached to the minutes) at 8% for 10 years. (Motion <br />carried. 4-0). <br />M/S/P Christ-Mazzara - to adopt Resolution 85-31 to assess the <br />property owners in the approved assessment roster as presented by <br />City Engineer Bohrer for Jane Rd. North (Exhibit B as attached to <br />these minutes) at 8% for 10 years. (Motion carried 4-0). <br />M/S/P Christ/Mazzara - to adjourn the assessment hearing at 8:45 <br />p.m. (Motion carried 4-0). <br />------------------ <br />Amended <br />
