RESOLUTION NO. 86-45 <br />A RESOLUTION DETERMINING THE NECESSITY FOR AND <br />AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTY <br />BY PROCEEDINGS IN EMINENT DOMAIN. <br />WHEREAS, the City Council has heretofore determined that <br />individual and joint land use wastewater treatment facilities <br />should be developed to protect the health, safety and welfare of <br />residents of the City of Lake Elmo. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LAKE ELMO, MINNESOTA, AS FOLLOWS: <br />1. Acquisition by the City of the following described <br />property is necessary for the purpose of providing <br />sites for joint land use wastewater treatment <br />facilities or easements thereto: <br />See Attachment A for a listing and description of <br />the properties to be acquired in fee simple interest <br />and the properties where easements are to be acquired. <br />2. The City Attorney is authorized and directed on behalf <br />of the City of Lake Elmo to acquire the above described <br />real estate by the exercise of the power of eminent <br />domain pursuant to Minnesota Statutes, Chapter 117, and <br />is specifically authorized to notify the owners of intent <br />to take possession pursuant to Minnesota Statutes, <br />Section 117.042. <br />The City Attorney is further authorized to take all <br />actions necessary and desirable to carry out the purposes <br />of this resolution. <br />ADOPTED BY the City Council this 7th day of October, 1986. <br />�- <br />Arlyn ClYrist, Acting Mayor <br />ATTEST: <br />%2, Y, Za <br />Robert Lee Overby <br />City Administrator <br />
