900 MINING AND FOREST MANAGEMENT <br />901 MINING <br />(� 902 FOREST MANAGEMENT <br />903 TREE DISEASES <br />901 MINING <br />901.010. Purpose. For the health, welfare, safety, .and optimum <br />land development, it is necessary to regulate the removal of sand, <br />gravel, rock, soil and other natural deposits in the City of <br />Lake Elmo. <br />Other purposes include the following: <br />A. To provide for the economical availability of sand, <br />gravel, rock, soil, and other materials vital to the continued <br />growth of the community. <br />B. To establish reasonable and uniform limitations, safe- <br />guards, and controls in the community, for the future production <br />of sand, gravel, rock, soil, and other natural resources. <br />C. To control noise, dust, hazards, effect on adjacent <br />property, and other factors related to the active mining and/or <br />excavating operation.. <br />D. To provide for control of the extent of excavation <br />compatible with the surroundings; and for the restoration of the <br />mining area after termination of the removal operation to make <br />the site compatible with the surroundings and the comprehensive <br />plan for development of the City. <br />E. To control pollution by erosion or sedimentation. <br />901.020. Definition. Mining shall include the excavation, re- <br />moval or storage of sand, gravel, rock, soil, clay and other <br />natural deposits within the community, except: <br />A. For the purpose of the foundation, cellar or basement <br />of some pending structure, for which a permit has been issued, <br />and which is to be erected immediately following the excavation, <br />removal or storage. or; <br />B. For the purpose of construction of sewer lines, storm <br />sewers, water mains, surface water drainage, agricultural or <br />conservation purposes and sod removal. Nor shall mining include <br />the moving of dirt for landscaping purposes on a lot used or to <br />be used for residential purposes. Nor shall mining include the <br />moving of dirt within the construction limits of a road project. <br />900-1 Amended by Ord. 7949 <br />
