901.030. Annual Permit Required. <br />I <br />A. It shall be unlawful for any person, partnership, <br />company or corporation to engage in mining within the commu- <br />nity or for an owner to permit a person to mine on his pro- <br />perty; without first having obtained aconditional use permit. <br />for mining from the City Council. <br />B. The applicant shall submit an application together <br />with the required fees to the Planning Commission. Property <br />owners within 350 feet shaj.l be notified by certified mail <br />to days prior to the date the Planning Commission considers <br />the request. The Planning Commission shall consider the re- <br />quest at its next regularly scheduled meeting, but not earli- <br />er than 10 days from the date of submission. The petitioner <br />or his representative shall appear before the Planning Commis- <br />sion, in order to answer questions concerning the proposed <br />mining. The Planning Commission shall make its recommendation <br />to the governing body within 60 days after the submission of <br />the application. The governing body must take action on <br />the application within 60 days of receiving the recommenda- <br />tion of the Planning Commission. If it grants the mining <br />permit, the governing body may impose conditions it considers <br />necessary to protect the health, safety, morals or general <br />welfare of the community and to insure the said use is in <br />harmony with the general purpose of intent of this ordinance <br />and the comprehensive plan. .No application for a mining per- (( <br />mit shall be resubmitted within six (6) months from the date \ <br />of denial. <br />C. A.permit, when issued, shall be valid for one year <br />unless terminated pursuant to Section901.040. <br />D. The City Council may waive the requirements <br />in subsection 901.030 B on a request for renewal. <br />901.040. Termination of Permit. <br />A. The City Council may terminate a mining permit for <br />violation of this ordinance or a condition of the permit, or <br />for violation of other applicable laws. <br />B. To terminate a permit, the City Council shall <br />give notice of the violation or other cause for the termina- <br />tion along with an order that the condition be remedied. If <br />the condition has not been repaired within two weeks, the <br />City Council shall hold a hearing to determine whether the <br />permit should'be terminated.. <br />C. No mining shall take place after the permit is ter- <br />minated pursuant to this section. <br />900 - 2 Amended by Ord. 7949 <br />
