RESOLUTION 86-21 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />WHEREAS, the Lake Jane Landfill was operated for many years <br />within this City by Washington and Ramsey Counties (hereinafter the <br />"Counties"); and <br />WHEREAS, the Lake Jane Landfill has created a serious <br />environmental and health problem for citizens of the City of Lake Elmo <br />as the result of groundwater pollution; and <br />WHEREAS, the aforesaid groundwater pollution has, in addition <br />to its health and environmental impact, substantially and negatively <br />affected property values in the area surrounding the Lake Jane <br />Landfill, resulting in lower assessed values; and <br />WHEREAS, the State of Minnesota has ordered the Counties to <br />take efforts to remedy the pollution problems created by their <br />landfill; and <br />WHEREAS, the Counties by earlier resolution had accepted a <br />public water supply as the appropriate resolution of the problem; and <br />WHEREAS, the City of Lake Elmo has over the past year, made <br />every good faith effort to negotiate with the Counties in order to <br />allow for construction of an adequate public water supply for the <br />affected area within the City; and <br />WHEREAS, Ramsey County has, despite said lengthy negotiations, <br />decided, without notice to the city, to install a stop -gap charcoal <br />filtration system in lieu of an adequate public water supply; and <br />WHEREAS, the City of Lake Elmo wishes it to be clearly <br />understood by all persons interested in this issue that it neither <br />shares nor accepts any responsibility for the decisions of Ramsey <br />County seeking resolution of this matter; and <br />WHEREAS, it has been the City of Lake Elmo's experience that <br />Ramsey County has demonstrated callous disrespect of environmental <br />problems created by their landfill in Lake Elmo, and as a result, has <br />shown itself to be an unresponsive and irresponsible landfill <br />operator. <br />
