LAKE ELMO CITY COUNCIL MINUTES APRIL 21, 1987 PAGE 5 <br />assurance from the City. A response letter was not drafted for this <br />meeting for City Council approval. <br />The public hearing was closed at 8:06 p.m. <br />Councilman Johnson has the same concern as the Planning Commission <br />that the letter be worded that it would not give "carte blanche" <br />approval if some other problem develops with the drainage with that <br />site; the City would not become liable because we have changed the <br />use. <br />M/S/P Graves/Moe - to grant the requested variance for sideyard <br />setback and approve the Site and Building Plan for the addition to <br />Lake Elmo Elementary School at 11030 Stillwater Blvd as presented to <br />the City Council on April 7, 1987, contingent upon successful <br />execution of a document for assurance for holding pond capacity <br />between the City, School District and Donald Raleigh and Calvin <br />Brookman:of,:13•rookfield, Inc.). (Motion carried 5-0). <br />D. Request for Rezoning from Rural Residential to Industrial <br />at TH5 & Stillwater Blvd. Joseph D. Rogers <br />Fred Richards, attorney representing Joe Rogers, explained that Mr. <br />Rogers would like to rezone the seventeen acre tract bounded by <br />Stillwater Blvd, the Chicago Northwestern Railway track and State <br />Highway 5 in order to allow his potential buyer, Brockman Trucking, to <br />develop the property for an industrial use. <br />Mr. Rogers purchased the site in 1978 and the site was zoned <br />industral. In 1979 the City amended its ordinances reclassifying this <br />property from industrial to rural residential. The first <br />comprehensive plan for the City showed this site as industrial. The <br />1979 Comprehensive Plan designated the site for future industrial use <br />after 1990. The 1986 draft of the comprehensive plan deleted all <br />references to industrial uses within the City. <br />Mr. Richards asked the Council to approve in concept the proposed use. <br />If Mr. Brockman wants to expand his operation in the future, he has to <br />come back before the Council and present those plans. <br />Bruce Folz gave a presentation on the description of the screening and <br />the three berm areas of the site and a brief summary of the proposed <br />plan. The proper use of this property is not for residential use with <br />the given railroad, major highway access system and the commercial use <br />to the west. There would be an on -site drainage system that would <br />adequately respond to all surface water or drainage problems that <br />might exist on this site as a result of the proposed use. A VBWD <br />permit would be required. As far as traffic problems, the technicians <br />that have looked at the site felt there would no stacking probems or <br />any problem with people coming around to the NE on Stillwater Blvd. <br />There wil be no traffic going north into the residential area or <br />traffic coming east on Hwy 5 inrothe business area. <br />Jim Brockman of Brockman Trucking explained they need this area for <br />storing trailers 2 or 3 times a year. He anticipates a maximum of 20 <br />
