LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 17, 1987 PAGE 4 <br />D. Rezoning from Rural Residential (RR) to Agricultural (A) <br />Douglas DeCoster/Thomas Armstrong. <br />The request for rezoning is application by Mr. DeCoster. The property <br />concerned involves a 20 acre parcel of RR zoned land abutting 10th <br />Street on the South and abutting Mr. Tom Armstrong's property on }he <br />east and the south. <br />The City Code requires (Section 301.090B Contiguous Parcels) that the <br />20 acre parcel "be combined with adjacent lots or parcels under the <br />same ownership so that the combination of lots or parcels will equal <br />one or more parcels of land each meeting the full lot width and area <br />requirement of this Ordinance." <br />Mr. Armstrong explained he intends to combine the 20 acre parcel with <br />his adjacent property, so that it can meet the 40 acre lot size <br />minimum needed for Agricultural zoning. The combination of parcels <br />will be done before the publication of the ordinance amendment <br />allowing the rezoning from RR to Agricultural. <br />The Planning Commission reviewed this request on 11-9-87 and <br />recommended that the City Council approve the request. <br />Concilman Graves asked City Attorney Knaak if there was any problem <br />where part of the 114.6 acres are Ag and the other portion of land is <br />Ag Preserve. Knaak res(onded that there was no problem. <br />Rose Armstrong asked City Attorney Knaak if he felt she had a conflict <br />of interest in downzoning from RR to Ag and no economic gain. Knaak <br />responded that it was a conflict of interest, but it was a judgement <br />for her to make. <br />M/S/P Johnson/Graves - to adopt Ordinance 8009 for rezoning 20 a --es <br />of land located on 10th Street in Section 28 from Rural Residential to <br />the Agricultural zoning district (legally described as the Southeast <br />1/2 of the Southwest 1/4 of the Southwest 1/4 of Section 28, Lake <br />Elmo) as being consistent with the 1986 Lake Elmo Comprehensive Plan, <br />subject only to the requirement that the 10 acre parcel be combined <br />with adjacent parcels prior to the effective date of the rezoning. <br />(Motion carried 4-0-1>Abstain: Armstroriq>). <br />E. Zoning Ordinance Amendment: Parks Corn ;.;; on f4eet_i nc - <br />The Pa" Jil-lar Illeeting from the first <br />Monday to the third Monday of the month. The ordinance needs to be <br />amended to allow this meeting change. The City staff felt that the <br />meeting requirements could be deleted from the Code and put in the <br />City's Policy Book. This change would allow future meeting schedule <br />changes without having to amend the ordinance again. <br />The City Council discussed this ordinance amendment at the meeting and <br />requested a copy of the draft ordinance amendment prior to taking <br />action. <br />
