LAKE ELMO CITY COUNCIL MINUTES JULY 19, 1988 PAGE 5 <br />Budget for the overlay of 32nd Street between Layton Avenue and <br />Klondike Avenue which was completed as Change Order No. 3. <br />M/S/P Graves/Moe - to approve Partial Payment No. 6 of Part D-201 <br />Project to Lake Area Utility Contracting in the amount of $39,872.17. <br />(Motion carried 5-0). <br />The City has been notified for the second time from the MPCA that our <br />request to add the Twin Points back into the program by change order <br />has been denied. Bohrer has requested a face-to-face meeting with <br />senior MPCA official in one last attempt to resolve the matter. <br />M/S/P Graves/Johnson - to direct the City Engineer to write an appeal <br />to the Director of the MPCA for construction of the Twin Points Tavern <br />system. (Motion carried 5-0). <br />The Council requested the staff to check on the status of the MPCA <br />letter requesting a public hearing, on renewal of the Permit for <br />Washington Co. Landfill $1, and report to the Council at the next <br />meeting. <br />C. FINAL PAYMENT --MAINTENANCE OVERLAY; TOWER ASPHALT <br />At the last Council meeting, the staff was granted permission to <br />solicit quotes and award the work for the following projects: <br />1988 Maintenance Overlays - Hill Trail, Jane Road, Jane Court <br />1988 MSA Maintenance - Gravel shouldering on 45th, Julep, <br />47th and Keats <br />Quotes were received and Tower Asphalt was the low bidder on both <br />jobs. Bohrer recommended that payments be made to Tower Asphalt in <br />the total amount of $20,334.50. <br />M/S/P Graves/Moe - to authorize payment to Tower Asphalt in the total <br />amount of $20,334.50 for work performed on Hill Trail, Jane Road, Jane <br />Court, 45th, Julep, 47th and Keats as outlined in the City Engineer's <br />memo of July 15, 1.988. (Motion carried 5-0). <br />D. PROPOSED ORDINANCE NO. 8020: ORDINANCE AMENDING SECTION 4 <br />The City Attorney had recommended incorporation of the Ordinance <br />within Chapt.400 of the Code, under subdivision and platting <br />procedures. At Council's direction, the staff had incorporated the <br />Attorney's draft ordinance recommendation, definitions of impervious <br />surface and surface runoff. The City Engineer concurred with the City <br />Attorney's recommendations. <br />M/S/P Johnson/Graves - to adopt Ordinance No. 8020 amending Sections <br />401.220 and 401.2240 of the 1979 Lake Elmo Muncipal Code, Relating to <br />Subdivision and Platting of Properties, by Adding to Paragraph Bic of <br />Section 401.220 and by Adding to Paragraph B3k of Section 401.240, <br />Relating to Stormwater Runoff Control. (Motion carried 5-0). <br />
