RESOLUTION 88-17 <br />A RESOLUTION FOR THE CITY OF LAKE ELMO <br />REGARDING THE DETACHMENT OF PART OF SECTION 32 <br />WHEREAS, the City of Lake Elmo, Washington County, is a statutory <br />city, existing and authorized pursuant to the laws of the State of <br />Minnesota; and <br />WHEREAS, there has been submitted by certain land owners within <br />the City of Lake Elmo, a petition for the concurrent Detachment and <br />Annexation of their property from the City of Lake Elmo to the City of <br />Oakdale pursuant to Minnesota Statutes 414.061, Subdivision 5; and <br />WHEREAS, those lands being sought for detachment are a vital <br />portion of the future planning for potential commercial development of <br />the contiguous area known as the City of Lake Elmo; and <br />WHEREAS, the sewer connection which the City of Oakdale would <br />have to access for services to the proposed annexed land is located <br />within the City of Lake Elmo; and <br />WHEREAS, the detachment of said land would result in the loss of <br />current and future tax revenue for the City of Lake Elmo; and <br />WHEREAS, the granting of said petition could result in the <br />precedent of piecemeal annexation of these lands and any others <br />currently within the City of Lake Elmo; and <br />WHEREAS, there has been no official communication between the <br />Cities of Lake Elmo and Oakdale regarding the issue raised by said <br />petition; <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council for the <br />City of Lake Elmo is opposed to the granting of said petition, and <br />FURTHER, that the City Council for the City of Lake Elmo feels <br />that it is not in the best interest of the citizens of Lake Elmo that <br />said petition be granted; and <br />FURTHER, that the staff is directed to gather such evidence as is <br />necessary to oppose said petition and appear and represent the City of <br />Lake Elmo at the Municipal Hoard hearing scheduled for March 29, 1988, <br />at 10:00 A.M. in the City Council Chambers for the City of Lake Elmo. <br />Adopted by the City Council of the City of Lake Elmo this 1.5th day of <br />March, 1988. <br />Signed: �- <br />ArlyngChrist, Mayor <br />Attest: <br />
