RESOLUTION 88-36 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION APPROVING THE FINAL PLAT FOR BROOKMAN 3RD ADDITION <br />WHEREAS, the City Council of the City of Lake Elmo has previously <br />considered and approved the preliminary plat of Brookman 3rd Addition; and <br />WHEREAS, the applicants have now presented to the City a final plat <br />which conforms to the approved preliminary plat and meets the requirements <br />of the City's Subdivision Ordinance. <br />WHEREAS, the Lake Elmo Planning Commission has reviewed the proposed <br />final plat at its August 8, 1988 meeting and recommended to the City <br />Council approval of said final plat. <br />WHEREAS, The City Engineer in his review letter of August 11, 1988 <br />states that the plans and specifications for Brookman 3rd Addition are <br />found to be acceptable. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Lake Elmo does hereby accept the final plat of Brookman 3rd Addition as it <br />is on file with the City Clerk subject to the following conditions: <br />1. The applicant shall enter into a developer's agreement, as <br />required by the City's Subdivision Ordinance, providing for the <br />construction of all streets and related improvements to City Standards to <br />be completed within one year. <br />2. The developers performance of said Developer's Agreement shall be <br />secured by security bond, cash deposit or letter of credit in a form <br />approved by the City Attorney or such other security as may be hereafter <br />approved by the City Council. The amount of said bond shall be determined <br />by the City Engineer in accordance with the provisions of the Subdivision <br />Ordinance. <br />3. All pass-thru expenses incurred by the City of Lake Elmo in <br />reviewing this plat will be paid to the City of Lake Elmo. <br />4. The Developer will (1) leave the 50 feet dedicated and provide an <br />additional 10 feet of permanent road easement along CSAH 17 to equal the <br />60 feet requested by the County and (2) obtain an entrance permit required <br />for street access for 39th Street. <br />ADOPTED by the Lake Elmo City Council this 16th day of August, 1988. <br />Signed: <br />Arlyn Christ, Mayor <br />Attest: <br />Patricia Morrison, ty Administrator <br />
