RESOLUTION 88-10 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT. TO <br />RUBEN LAUSENG - LAUSENG STONE, FOR OPEN SALES LOT <br />IN THE AGRICULTURAL ZONING DISTRICT <br />WHEREAS, Ruben Lauseng has applied for a Conditional Use <br />Permit for an Open Sales Lot: on 87A-N.1/2 of NE1/4 of Section 3, T29, <br />R21, (Page 19, 1983 Assessment Book) at 9591 60th Street North in the <br />City of Lake Elmo; and has submitted all required information and fees <br />for the application for such permit; and <br />WHEREAS, Section 301.050 B of the Municipal Code of Lake <br />Elmo requires a Conditional Use Permit to operate an Open Sales Lot in <br />the City of Lake Elmo; and, <br />WHEREAS, Sections 301.130 C., D., E., F. and G of the <br />Municipal Code of Lake Elmo sets forth the conditions under which said <br />permit may be granted and such use permitted; and <br />WHEREAS, the applicant meets or exceeds all the conditions <br />set forth above. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Lake Elmo, <br />THAT, the Conditional Use Permit for an Open Sales Lot at <br />9591 60th Street North is hereby granted to Ruben Lauseng - Lauseng <br />Stone, subject to the following conditions: <br />1. The hours of operation shall be 8:00 a.m. to 8:00 p.m., <br />Monday thru Saturday and 10:00 a.m. to 5.00 p.m. Sunday. <br />2. There shall be an on -site business sign only. <br />3. No material shall be stored closer than 210 feet south <br />of Highway 36 right-of-way. <br />4. The owner shall maintain it as per 1979 site plan. <br />5. There shall be no expansion beyond area and function <br />now being used. <br />6. The Screening shall be maintained. <br />7. There shall be no more than 30 cams parked on the site. <br />This Conditional Use Permit will be reviewed on an annual basis, and <br />may be rescinded, after a 2 week notice and a public hearing, if the <br />City Council finds that the public health, safety, or welfare is <br />jeopardized. <br />
