LAKE ELMO CITY COUNCIL MINUTES MAY 16, 1989 PAGE 2 <br />Attorneys Dayton and Sampson have declined based on their work schedule, <br />but they have given Todd the names of two attorneys they recommended that <br />are well known in the Legislature and knowledgable about waste management <br />issues. REAPP has indicated it would be willing to kick in some money, if <br />it is required, if the final bill was over a $1000. This $1000 will be <br />taken out of the $200,000 allocated by the voters. <br />M/S/P Graves/Hunt - to authorize expenditure of up to $1000 for lobbying <br />efforts on the Solid Waste Management Act that is being considered by the <br />1.989 Legislature with the attorney to be identified by REAPP. (Motion <br />carried 5-0). <br />5. IMPROVEMENT HEARINGS: <br />City Engineer Larry Bohrer provided assessment alternatives for the <br />Council's consideration. The alternative methods are: Benefitted Front <br />Foot Method, Unit Charge, and Combination Method. Lists were provided <br />showing the property owners abutting on or benefitting from the street <br />improvement. <br />A. 15th Street, Inwood Avenue to West City Limits, Resolution 89-28 <br />Mayor Dunn opened up the public hearing at 7:30 p.m. in the City Council <br />chambers. <br />Proposed Improvement: <br />The street would be constructed to Municipal State Aid Standards for a <br />rural road. 15th Street would have two 12 foot driving lanes and 4 foot <br />wide paved shoulders. Poor soils would be removed from the roadbed and <br />would be replaced with suitable material. Driveways would be paved from <br />the edge of the shoulder to property line. The ditches would be graded <br />and new culverts installed. The road will be designed for 40 mph speeds. <br />The estimated project cost is $158,000. <br />It has been the City's policy on other State Aid streets to assess only <br />those costs which are not eligible for State Aid reimbursement. The only <br />items not eligible for State Aid reimbursement are legal fees for an <br />acquisition, engineering costs in excess of 18% of the construction cost <br />and City administrative costs. The estimated assessable cost is $7,000. <br />John Bodey, 8155 15th St. N., asked if Oakdale had plans to upgrade their <br />section of 15th St. Bohrer answered that 15th Street was not presently in <br />Oakdale's 5-year plan. Bodey asked if the new road would be sufficient to <br />handle the amount of truck travel. Bohrer answered this road would be <br />designed for 9-ton minimum axle load all year around. <br />Leo Pierre, speaking for his father living at 8167 15th St. N., stated he <br />believes the road should be rebuilt, but the assessment was too large for <br />the small parcel (1.3 acres) his father owns. He would like a maximum <br />speed of 40 mph. <br />Rob Pierre, 8167 15th St. N., asked, if more property is needed for the <br />road and the shoulder, would he be compensated for this .land or the two <br />big trees that might be taken down. Bohrer explained they have done some <br />preliminary surveys, but they would know within the next 2-3 weeks if they <br />
