LAKE ELMO CITY COUNCIL MINUTES MAY 16, 1.989 PAGE 3 <br />' need more property. If property is needed from Mr. Pierre, he would be <br />entitled to compensation for that strip of land, and trees, which are <br />considered. part of that value. Pierre responded that if he got something <br />out of it, then he could afford to pay a little assessment. <br />Thomas and Rosemary Armstrong submitted a petition, of which the <br />petitioners are property owners of more than 35 percent of the real <br />property abutting on 15th Street west of County Road 13 and east of the <br />Oakdale border, requesting the City to pass a resolution ordering the <br />improvement project as outlined in the feasibility study of May 2, 1989. <br />Tom Armstrong, 8291 15th St. N., stated that normally the City has used <br />the "unit assessment method", for people that live on cul-de-sacs who have <br />narrow frontages and other people that have wide frontages, because it is <br />the only fair thing to do is charge everybody equally. In this particular <br />street, there are no people with corner lots or who own a lot with narrow <br />frontage on it. Armstrong stated he was in favor of this project and was <br />willing to use a "front foot assessment method" because in this particular <br />project it is the fairest way to do it. <br />Steve DeLapp, 8468 Lake Jane Trail, requested consideration by the City <br />Engineer on all the street projects, especially when there is a straight <br />road going through farmland, that they try to make a little "squiggle" so <br />they can save the trees that are worth something, rather than bulldoze <br />these trees just for the sake of a. State law. <br />Bohrer responded that the trees are on the high point of the hill and the <br />hill has to be lowered to improve the site distance. When you lower the <br />grade, this makes the slopes go out farther. <br />Mayor Dunn closed the public hearing at 7:55 p.m. <br />in Resolution 89-29, Councilman Hunt suggested adding a paragraph stating: <br />WHEREAS, a petition has been received by the City of Lake of more than 35 <br />percent of the front footage property owners <br />M/S/P Hunt/Graves - to adopt Resolution 89-2.8, as amended, ordering <br />Improvement and Preparation of plans for 15th Street from Inwood Avenue to <br />West City Limits. (Motion carried 5-0). <br />B. 20th Street, Lake Elmo Avenue to Manning Trail, Resolution 89-29 <br />Mayor Dunn opened, up the public hearing at 8:00 p.m. in the City Council <br />chambers. <br />Proposed Improvement: <br />20th Street has been patched and had spot overlays done over the past few <br />years; however, the road surface continues to break up due to inadequate <br />subgrade strength. It is recommended that a 2" overlay be placed over the <br />street to increase the strength of the road and to seal off the cracks. <br />Gravel would be added to the shoulders to bring them up to finished grade. <br />Existing driveways will not be altered. A tapered edge will be raked out <br />at each entrance. The total estimated project cost is $49,000. <br />
