However, General Concept Approval is contingent <br />upon applicant accepting the RE zoning classification upon completion of <br />the RE Zoning Ordinance and implementation into the Lake Elmo Municipal <br />Code and the Lake Elmo Comprehensive Plan, as The Forest has made every <br />effort to meet the minimum requirements suggested in the preliminary <br />standards setforth for the RE zoning district. (Motion carried 5-0). <br />7. CITY ENGINEER'S REPORT: <br />A. Report on White Hat Fill Permit <br />M/S/P Graves/Williams - to bring back for reconsideration Ed Gorman's fill <br />permit. (Motion carried 5-0). <br />Ed Gorman, owner of the White Hat Restaurant, submitted a letter to the <br />Council proposing to submit a site plan showing existing and proposed land <br />elevations in 2-foot contours, drainage provisions, drainfield locations, <br />holding pond location and. a. general. concept plan for proposed expansion to <br />the City by December 1, 1989. <br />Larry Bohrer advised the Council that the City needs more detailed <br />perameters for fill applications than what the City has now when Mr. <br />Gorman was issued a fill permit. Limitations suggested were: 0-100 <br />cu.yds. application be administratively granted., 101-500 cu.yds. requires <br />site plan, over 500 cu.yds. requires a full grading plan with contours. <br />Bohrer added he would not want the fill graded out and spread over a <br />larger area just for the sole purpose of stabilizing it until a plan is <br />forthcoming because this amount of fill will compact the natural soils <br />underneath it and may render it unuseable for drainfield purposes. <br />Initial assumptions are being made here, Bohrer stated, that this is going <br />to prove suitable for a drainfield. These responsibilities are Mr. <br />Gorman's not the City's. <br />Because of the volume of fill. brought in without any specific grading or <br />site plan Mayor Dunn voiced her concern with the drainage in this area. <br />Ed Gorman responded that Mr. Schiltgen's topsoil has been running across <br />his drainfield for the nine years he has been there. <br />Councilman Moe stated there are other people in that same area that <br />contribute water, or that have land that sits vacant 6-7 months out of the <br />year. if we are going to pose restrictions we should look at the broad <br />issue. Bohrer answered there are guidelines for Ag land put out by the <br />soil conservation service on soil loss limits to water erosion, wind <br />erosion, etc. <br />MIS/ Graves/Moe - to reinstate the current White Hat Fill Permit to Ed <br />Gorman, for up to a maximum of 20,000 cu.yds. which expires Sept. 20, 1989 <br />with the understanding that no further consideration of extension of the <br />fill permit will be granted unless all the requirements as stated in our <br />ordinances for concept plan approval such as: contours, grading and site <br />plan, drainfield location, building location, are submitted and approved <br />by the Council. <br />
