LAKE ELMO CITY COUNCIL MINUTES JUNE 20, 1989 PAGE 5 <br />E. Request for Amendment on Council Action: Steven Dahly <br />M/S/P Williams/Bunt - to consider the request by Steven Dahly for <br />amendment on Council Action. (Motion carried 4-0). <br />At the April 4th meeting, the Council approved a Large Lot Subdivision <br />for Steven Dahly, on property south of 15th Street, east of Inwood. <br />Four conditions were attached to the approval. Mr. Dahly would like <br />structure defined as "primary structure" in the the fourth condition, <br />"any structure be set back 100 feet from pipeline". <br />Although the City does not have this setback requirement in the Code, <br />this was a recommendation from our City Engineer for the purpose of <br />protecting human life --it was never intended to serve as protection <br />against property damage. The City Engineer agreed with Mr. Dahly that <br />the word "structure" was quite broad, and that his intent in making <br />this recommendation was for the primary structure. <br />Councilman Williams requested that "primary structure" be changed to <br />"principal structure" because it would be in concert with our code <br />definition. <br />M/S/P Graves/Bunt - to define structure as principal structure as it <br />relates to the recommended 100 foot building setback setforth as ($4) <br />condition in granting a large lot subdivision to Steven Dahly at the <br />April. 4, 1989 City Council meeting. (Motion carried 4-0). <br />F. Planning Commission Recommendation re: Road Widths <br />For their consideration the Council received memo from City Engineer <br />Larry Bohrer, Dan Olinger and the Planning Commission's <br />recommendations on road widths. <br />The staff was directed to consider this as a policy statement and <br />requested reasons why Fire Chief, Fran Pott, had his amendments to <br />road widths and on what basis did the PZ base their recommendations <br />on. <br />M/S/P Bunt/Graves - to postpone consideration of the Planning <br />Commission Recommendations on Road Widths until the July 18, 1989 <br />Council meeting in order for the Council to receive reasons why Fire <br />Chief Pott had his amendments and a copy of the PZ basis for their <br />recommendation. (Motion carried 4-0). <br />7. PUBLIC IMPROVEMENT BEARING: Layton Avenue <br />Mayor Dunn opened up the public hearing at 8:08 p.m. in the City <br />Council chambers. <br />Public hearing notice was duly published and mailed. <br />( <br />When he reviewed the feasibility study for Layton Avenue and 36th <br />Street, Larry Bohrer advised the Council at the May 2nd Council <br />meeting, that this improvement should not be done until permanent <br />
