LAKE ELMO CITY COUNCIL. MINUTES JUNE 6, 1989 PAGE 6 <br />Chuck LeMire, 8084 Hill Trail N., stated he lived there 16 years and would <br />like .the City to" compensate Mrs. Meier for the property and keep it as <br />a nature area. <br />A. Siegel, 7951 Hill Trail Ct., stated he didn't like the idea of hacking <br />up the residential area with later day roads. The area is of low <br />elevation and has a concern on runoff and more swamp and brush. He asked <br />who would pay for an improved access. <br />Arlene Grayson, 1916 E. 4th St., St. Paul, daughter of Mrs. Meier, asked <br />if theycould collectively come together with creative thinking to address <br />this situaiton now. Richard Meier, son of Mrs. Meier, stated his father <br />has been paying taxes on this property since 1958. Perk tests have not <br />been done until access can be determined. <br />Mayor Dunn closed the public hearing at8:35 p.m. <br />Councilman Hunt asked the City Attorney.if the Council should not approve <br />this right-of-way access, does this constitute taking of land. Knaak <br />answered that this land has been unbuildable for many years, but the <br />Meier's would not be aware of it until they came in with a request. The <br />Council was under no obligation to approve this request. <br />Larry Bohrer stated there is access to the property, but building a <br />driveway to a house is another matter. The attorney stated she can <br />utilize this as an access, but to bear in mind, if she should miss it, she <br />would be considered trespassing. <br />MIS/ Graves/Moe - to deny the variance request for lot size and frontage <br />based on no hardship was presented, and there was a potential for other <br />variances being required because a contour map, building site plan and <br />soil borings have not been submitted and potential disruption to the <br />adjoining propertyowners. <br />Councilman Williams suggested the propertyowners and. Mrs. Meier get <br />together to decide if they are interested in buying this land. Councilman <br />Hunt was against the variance requests, but favored keeping the public <br />hearing open so the Council could respond to the propertyowners' requests. <br />M/S/P Williams/Hunt - to postpone consideration of this motion until the <br />June 20th Council meeting in hopes the property owners can get together. <br />(Motion carried 4-1: Graves: He sees variances for: lot size, road <br />frontage, building a non -conforming road, size of the lot for septic <br />system (perkable soils) with potential variances needed to put a structure <br />in the future. If multiple variances are granted, this makes our code <br />ineffective) <br />The Council suggested Mrs. Meier contact the assessor for a fair market <br />value and the City would provide them a list of adjacent propertyowners to <br />contact that might be interested in purchasing this land. <br />E. PLANNING COMMISSION FORMAL MOTIONS: May Meeting <br />An extract of the Planning Commission motion of their May 22nd meting was <br />submitted to the Council. <br />
