LAKE ELMO CITY COUNCIL MINUTES AUGUST 15, 1989 PAGE 4 <br />to allow release of surface water from the storage pond into Lake Elmo. <br />Therefore, the following amendment was made: <br />M/S/P Williams/Hunt - to amend the motion to include direct the city staff <br />to contact the VBWD to request permission to allow controlled release of <br />surface water from the existing storage pond into Lake Elmo Lake. (Motion <br />carried 4-0). <br />M/S/P Hunt/Williams - to postpone consideration of Packard Park 3rd <br />Addition until the September 5th City Council meeting and to direct the <br />City Staff to contact the VBWD to request permission to allow controlled <br />release of surface water from the existing storage pond into Lake Elmo <br />lake. (Motion carried 4-0). <br />D. Planning Commission Motions: August 14, 1989 <br />Information Item. <br />6. CITY ENGINEER'S <br />REPORT: <br />A. Resolution <br />No. 89-36: <br />Resolution Calling <br />for Assessment Hearings <br />City Engineer Larry Bohrer reported assessment hearings need to be <br />scheduled for the following improvement projects: <br />1. 20th Street <br />2. 38th and 39th Streets <br />3. 33rd Street and Klondike Avenue <br />4. 43rd Street and Kimbro Avenue. <br />These hearings must be held prior to October 10, 1989. Two suggested <br />dates were the regular Council meeting on Tuesday, October 3rd, or a <br />special meeting on Tuesday, September 26. A total of 88 individuals will <br />be notified of the hearings. <br />M/S/P/ Williams/Hunt - to adopt Resolution 89-36 calling for Assessment <br />Hearings for the 1989 Street Improvement Projects for Tuesday, September <br />26th at 7:00 p.m. (Motion carried 4-0). <br />7. CITY ATTORNEY'S REPORT: <br />A. Order to Repair or Raze Building (Cozy Cove) <br />The City has made several attempts to work with Elmer Haase, the owner of <br />the Cozy Cove located at 7676 Hudson Boulevard, to upgrade his facility to <br />comply with the Building Code (Building officials's memo dated August 1, <br />1989). <br />The City Attorney provided an Order to Repair or Raze the buildings. <br />Attorney Knakk explained the City has been pursuing two avenues to address <br />this situation, ie: (1) legal: violation of the building code, and (2) by <br />working with the Lake Elmo Fire Department: two buildings (out of 4) are <br />scheduled to be burned (dependent upon weather) on Saturday, August 26th. <br />
