LAKE ELMO CITY COUNCIL, MINUTES OCTOBER 17, 1989 PAGE 2 <br />driveway access is small and regular size vehicles are hard to maneuver. <br />The garage does not provide adequate storage space (his house has no <br />basement), nor enough room to house both vehicles or allow for summer boat <br />storage. <br />Letters were provided from the abutting property owners, Douglas Magnuson <br />at 9198 31st St. and Eugene Merier at 9240 31st St., in which they <br />indicate approval of this request. Jim McNamara, Lake Elmo Building <br />Official, stated in his memo, dated October 13, 1989, an inspection of the <br />property indicated this location would be appropriate for the requested <br />addition contingent upon Council. approval. The addition would not <br />interfere with the septic system or the expansion of the drainfield area, <br />if needed in the future. <br />Mayor Dunn closed the Public Hearing at 7:35 p.m. <br />Mayor Dunn and Councilman Moe had visited the site and indicated this <br />would be the only area to place the garage. Councilman Williams had <br />visted the site, had a concern for an alternate drainfield site on a lot <br />this small and concern that a legal hardship was demonstrated. Councilman <br />Hunt explained our City has many small lots that have been left over from <br />previous developments prior to restructuring of our Code and most people <br />consider a two -car garage today a necessity. There are unique features on <br />this .land that are keeping him from going into any other direction. The <br />layout of the land does appear to warrant this variance. <br />M/S/P Hunt/Moe - to approve the variance to sideyard setback (2 1/2 feet <br />versus 10 feet) for Thomas Arcand, 9202 31st Street N., to construct an <br />addition of approximately 190 sq.ft. to an existing 360 sq.ft, garage; <br />based on hardship being the layout of the lot only enables Mr. Arcand to <br />go to the West direction with his addition; There was no opposition <br />received from the neighbors, letter dated October 13, 1.989 from Jim <br />McNamara stating this location would be appropriate for the addition and <br />the addition would not interfere with the septic system for the expansion <br />of the drainfield area. (Motion carried 4-0). <br />B. PUBLIC: HEARING: Variance: Size of Accessory Building <br />Steve Johnson, 2945 Lake Elmo Avenue <br />Mayor Dunn called the public hearing to order at 7:45 p.m. in the City <br />Council chambers. The Public Hearing notice was published and all <br />propertyowner.s adjoining this property have been notified. <br />Stephen and Elizabeth Johnson are requesting a variance to the size of an <br />accessory structure in the R1 Zoning District. The applicant proposes a <br />2000 sq.ft, accessory structure whereas 1000 sq.ft. is allowed by code. <br />The applicants are in the process of purchasing the property at 2945 Lake <br />Elmo Avenue, along with a 30 foot parcel of land that would allow access <br />to the back of this property off of 30th Street. There is, presently, no <br />access to the rear parcel, and the house is on a very small lot with no <br />room for a driveway on either side of the house. <br />Steven Johnson stated they have lived at 5831 Hytrail in Lake Elmo for 12 <br />years and are in the process of purchasing 2945 Lake Elmo Avenue. They <br />are requesting.a 2,000 sq.ft. accessory (Morton) storage building to store <br />
