LAKE ELMO CITY COUNCIL MINUTES OCT08ER 17, 1989 PAGE 4 <br />detract from the house which is seen from Lake Elmo Avenue. He does not <br />j get full benefit 'Of the property. If there is an heir to the Collopy <br />Estate, Johnson stated he will buy this strip to have an access to this <br />property which would make almost five acres total. Dunn suggested the <br />applicant come back when this is settled. <br />Councilman Williams clarified the variance request before the Council is <br />not hinged on the access to the property. The Council was going beyond <br />their legal authority and should address this specific variance request at <br />this time. Williams could not accept possession of many vehicles as a <br />legitimate hardship. <br />Administrator Morrison pointed out the applicant could not subdivide this <br />property because he does not have proper road frontage and a hardship, <br />other than economic, has to be demonstrated. <br />Johnson asked the Council about the possibility of erecting a 1,000 sq.ft. <br />accessory building with a 1,000 sq.ft. canopy to keep the snow off the <br />motorhome. Esthetically to the neighborhood, Johnson felt the motorhome <br />should be enclosed rather than leave it outside. The Council looked at <br />this as a building code question and asked. Mr. Johnson to contact the <br />Building Official to review this proposal. <br />M/S/P Williams/Hunt - to deny the variance request of Stephen and <br />Elizabeth Johnson, 2945 Lake Elmo Avenue, for size of accessory structure <br />in R1 Zoning District, 2000 sq.ft. versus 1000 sq.ft. allowed by code, <br />based on lack of a demonstrated hardship. (Motion carried 4-0). <br />C. Resolution No. 89-42 Large Lot Subdivision: Gilbert Sullwold <br />At the March 7, 1989 Council meeting, the staff was directed to draft a <br />resolution granting a large lot subdivision to Gilbert Sullwold. The <br />Council reviewed the draft resolution. <br />M/S/P Williams/Moe - to adopt Resolution 89-42, as presented, granting a <br />large lot subdivision to Gilbert Sullwold. (Motion carried 4-0). <br />D. Reconsideration of Extension of Fill Permit for Ed Gorman <br />M/S/P Williams/Hunt - to open for reconsideration the motion to deny Ed <br />Gorman's request of fill permit extension. (Motion carried 4-0). <br />Councilman Williams prepared, with the assistance of the City Attorney, <br />appropriate Findings of Fact in a Resolution. The Council reviewed the <br />submitted Resolution and amended the following: No. 12 .....drainage, it <br />being a source of, <br />M/S/ Williams/Hunt - to adopt Resolution 89-48 with amended wording in <br />No. 12... drainage, it being a source of <br />M/S/P Williams/Hunt - to amend wording in paragraph FURTHER RE IT <br />RESOLVED, the word "development" be stricken and "site plan" be inserted. <br />for further clarification. (Motion carried 4-0). <br />
