RESOLUTION NO. 89-27 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION FOR THE CITY OF LAKE ELMO <br />REGARDING THE PROPOSED ANNEXATION OF CERTAIN <br />PROPERTIES IN SECTION 8 OF OAKDALE <br />WHEREAS, The City of Lake Elmo, Washington County, is a statutory <br />city, existing and authorized pursuant to the laws of the State of <br />Minnesota; and <br />WHEREAS, certain individuals owning land in Section 8, Township 29 <br />North, Range 21 West, all within the City of Oakdale, have submitted <br />to the City of Lake Elmo, a petition for detachment of their property <br />from the City of Oakdale and annexation to the City of Lake Elmo as <br />part of a process described in Minnesota Statute 414.061, subd. 5; <br />and, <br />WHEREAS, this land includes all resident petitioners in Oakdale living <br />north of State Hwy 5 and east of Interstate 694 and are in an area <br />with limited development potential without the installation of a <br />public sanitary sewer system; and, <br />WHEREAS, the land contributes to the Olson Lake subwatershed in Lake <br />Elmo and has a morphology similar to adjacent land in Lake Elmo; and, <br />WHEREAS, the land is contiguous to Lake Elmo; and <br />WHEREAS, the urban services proposed by Oakdale for this area are <br />incompatible with the existing needs of the petitioning residents and <br />would be detrimental to the adjacent residents of Lake Elmo, and the <br />adjacent park facilities and lakes used by the petitioners are in Lake <br />Elmo and the highway system used by the residents is primarily <br />serviced by Washington County and 44th Street would be more easily <br />serviced by the City of Lake Elmo; and, <br />WHEREAS, the use of the land without public sewers is incompatible <br />with all other land use in the City of Oakdale, and a proposal for a <br />sewer lift station to serve the area is incompatible with the needs of <br />the property owners and inconsistent with the Comprehensive Plan of <br />Oakdale, which prohibits the installation of temporary lift stations, <br />and which could only be made permanent with a complete change in the <br />land use planning for Lake Elmo by routing a gravity pipe through Lake <br />Elmo; and, <br />WHEREAS, the existing services to the land could be more economically <br />provided by the City of Lake Elmo; and, <br />
