LAKE ELMO CITY COUNCIL MINUTES JANUARY 2, 1.990 PAGE. 7 <br />( M/S/P Hunt/Williams - to appoint the Council as a whole to serve as a <br />committee for budget, capital improvement and personnel matters until <br />such time as the vacant Council seat is filled, and we can appoint <br />separate committees for Budget, Capital Improvement and Personnel. <br />(Motion carried 4-0). <br />M/S/P Williams/Graves - to amend the agenda to consider the resolution <br />regarding revoking suspension of Building Permit for Steven and <br />Elizabeth Johnson before Agenda Item B. (Motion carried 4-0). <br />Councilmen Williams and Graves, City Attorney Carlson, met with Mr. & <br />Mrs. Johnson and their attorney to work out an agreement that is <br />satisfactory to both sides. The resolution presented formalized this <br />agreement and allowed Mr. & Mrs. Johnson to continue with construction <br />of their garage. <br />M/S/P Williams/Graves - to adopt Resolution 90-1, Resolution Revoking <br />Suspension of Building Permit #89-254 for Stephen and Elizabeth <br />Johnson at 2.945 Lake Elmo Avenue N. (Motion carried 4-0). <br />Mayor Dunn recognized Scotty Lyall who requested to speak. <br />In relation to the City's legal newspaper Scotty Lyall commented, when <br />he stuffs newspaper boxes with his business advertisements, he does <br />not find many Review papers still in the box, but what he does find is <br />yellowed colored. Press newspapers. Lyall asked for further <br />investigation into this. <br />Scotty requested, Council consideration to begin giving regular <br />peforma.nce appraisals to all employees. Scotty felt the employees <br />deserve that and the Council should --have --these-appraisals-for-their <br />own protection. <br />8. PLANNING, LAND USE AND ZONING : <br />A. PUBLIC HEARING: Variance to frontage on public street <br />requested by Gerald Dalluge (50th Street) <br />Mayor Dunn opened up the Public Hearing at 8:24 p.m. in the Council <br />chambers. The Public Hearing notice was published and all affected <br />propertyowners were notified. <br />Gerald Dalluge has requested a variance to the required 300 feet of <br />frontage on a public street at 11330 50th Street N. Mr. Dallluge plans <br />on building on the back lot, restricting the house to the north side <br />of the piece of property for privacy reasons. <br />Staff reported they have searched the records and have not been able <br />to find records of any action taken by the City and had checked with <br />Washington County and found the lot split goes back to at least 1974. <br />According to the 1-974 Lake Elmo Municipal Code, staff felt this split <br />was made under those rules. There didn't appear to be much required <br />for a subdivision at that time, however, a 66 foot road easement was <br />recorded through the west side of Tract A. It appeared that there may <br />have been a plan, back in the 1970's for a road to go thru, but no <br />
