ELMO CITY COUNCIL MINUTES JANUARY 2, 1.990 PAGE. 9 <br />from that lot Leaving approx. one acre for that lot, Mr. Bucheck asked <br />if this conforms to the requirement that the area have 1 1/2 acre <br />lots. <br />Planning Commission member Dick Johnson wanted to make the Council <br />aware there is a problem in the definition of the requirement "one <br />acre of land suitable..." and clarification is needed to be consistent <br />with the statement in the Comp Plan. <br />M/S/P Graves/Hunt - to approve the Final. Plat of Packard Park 3rd <br />Addition with Conditions 1-4 listed in Larry Bohrer's letter of <br />November 21, 1989 and to direct the staff to prepare the resolution <br />and developer agreement for this final plat. (Motion carried 4-0). <br />Councilman Williams thanked the Planning Commission for working so <br />hard on this plat and for raising concerns that needed to be raised. <br />Larry Bohrer stated he is definitely aware of the provision in the <br />Comprehensive Plan. Until that is officially adopted and the code is <br />amended to agree with the Comp Plan, Bohrer asked how should the <br />phrase be interpreted in the interim time. <br />M/S/ Williams/Hunt - to recommend the zoning code, where appropriate, <br />be modified such that all lots shall have at least one contiguous acre <br />of land suitable for septic sytems and dedicated, exclusively for <br />septic systems, as well as areas sufficient for two separate and <br />distinct drainfield sites and direct the staff to publish a public <br />hearing notice to institute this change in the Zoning code. <br />Larry Bohrer suggested the staff come up with sample wording for <br />Council review. <br />Councilmen Williams and Hunt withdrew their motion. <br />M/S/P Williams/Hunt - to direct the City staff to come up with <br />proposed wording to institute the suggested changes for the February <br />6th Council meeting. (Motion carried 4-0). <br />C. Shor.eland Permits <br />The City received, through the DNR, two applications for DNR permits. <br />Neither applicant applied directly to the City, but rather applied to <br />the DNR, and the City is responding to their request for comment. <br />1. Ken Isaacson, 8009 Hill. Trail. N., has applied for a <br />permit to allow placement of clean aggregate on his vacant property on <br />the north side of Lake Olson. Larry Bohrer reported in his letter <br />dated December 28, 1989 that the aggregate will be placed between the <br />road and the Ordinary High Water Mark for the purpose of erosion <br />control. Bohrer recommended the Shoreland Permit be granted because <br />this work is allowed under the ordinance and no variances are <br />required. He recommended the City inform the DNR that it has no <br />objection to issuing a State permit for the work. The VBWD has <br />already issued their permit for the work. <br />
