LAKE ELMO CITY COUNCIL MINUTES JANUARY 2, I.990 PAGE 10 <br />l M/S/P Williams/Graves - to grant a Shoreland Permit to Ken Isaacson, <br />8009 Hill Trail N., for placement f 35 cubic yards of clean aggregate <br />on his vacant lakeshore ,property; contingent upon Mr. Isaacson <br />applying for a City Shoreland Permit and contingent upon DNR approval. <br />(Motion carried 4-0). <br />2. James Buelow <br />Mr. Buelow has applied for a DNR permit to construct a bridge for a <br />driveway access across Eagle Point Creek. The creek bisects Lot 10, <br />Beau Haven Addition which Mr. Buelow owns. This work is also governed <br />by the City's Shoreland Regulations because the shoreland district in <br />this area is 300 feet either side of the creek. The VBWD has reviewed <br />the hydraulic characteristics of the bridge and has issued their <br />permit for the work. <br />In his letter dated Decemebr 28, 1989 to the Council, Larry Bohrer <br />recommended Ahding out the owner's intention for the lot first before <br />passing on this permit application. The lot is slightly over 0.5 acre <br />in size and does not meet the 60% Rule for existing platted lots of <br />record. Not all of the land is useable because of the flood.plains. <br />Bohrer had no objection to the bridge itself because the Watershed <br />District has checked that the 100 year flow can pass beneath. <br />Mr. Buelow has provided soil tests and is ready to start building and <br />has indicated, his intention is to put up a "spec" house for resale. <br />Howard Michaels, who is the adjacent landowner, stated he has no <br />desire to sell any of his land. <br />Larry Bohrer explained the next application would be a subdivision, if <br />there is a willing seller and buyer, to subdivide an acre off and <br />combine it with Lot 10. <br />M/S/ Graves/Hunt - to postpone consideration of the shoreland permit <br />for James Buelow, Lot 10 Beau Haven, until such time as it can be <br />determined if the lot is buildable and that the DNR be notified of the <br />situation and asked to postpone consideration of the permit also. <br />When the Attorney was asked by Councilman Williams if he was <br />comfortable with the motion, Knaak advised not to put the condition in <br />the motion. <br />M/S/P Williams/Graves - to strike the condition out of the motion. <br />(Motion carried 4-0). <br />M/S/P Graves/Hunt - to postpone consideration of the Shoreland Permit <br />for James Buelow on Lot 10, Beau Haven and the DNR be notified of the <br />situation and asked to postpone consideration of the permit also. <br />(Motion carried 4-0). <br />
