Taylor, the owners of
the Lake Elmo real property highlighted in yellow on the attached
Plat map. The property is subject to an old easement (outlined in
Red) which has never been used or activated.
The Taylors have initiated a Proceeding Subsequent (copy attached)
which will extinguish the easement. Washington County Examiner of
Titles Harold Kimmel has issued the enclosed report which indicates
i that the Taylors own the property and that the property subject to
the easement initially created by the Collopys was not retained by
the Collopys.
It has come to our attention that Mr. Steve Johnson will approach
the Council next Tuesday night and ask for a permit for a driveway
across the easement parcel. Apparently Mr. Johnson is claiming
that heirs of the Collopys have given him a deed to the property.
Please note that it is our position that any such deed is
meaningless. In short, we most strongly oppose the granting of any
driveway permit over the Taylors property.
If you have any questions, please call.
Yours very truly, `
Alan T.
