AGREEMENT <br />(DETACHMENT AND ANNEXATION OF LAND) <br />THIS AGREEMENT, Made and entered into this day of May <br />1990, by and between the CITY OF LAKE ELMO ("Lake Elmo"), and the CITY OF <br />OAKDALE ("Oakdale"), jointly called the "Cities"; <br />WITNESSETH THAT : <br />WHEREAS, the Cities share a common boundary; and <br />WHEREAS, The owners of real property in Lake Elmo located in Section <br />32 Township 29 North, range 21 West, Washington County, Minnesota, as <br />described in Exhibit "A" attached hereto, have petitioned the Minnesota <br />Municipal Board for detachment of their property from Lake Elmo and its <br />annexation to Oakdale; and , <br />WHEREAS, a hearing was held before the Minnesota Municipal <br />Commission Board on March 29, 1988, and Findings of fact, Conclusions of <br />Law and Order was issued on September 23, 1988, and amended on October 17, <br />1989, which ordered the detachment of the property described in attached <br />Exhibit "A" from Lake Elmo and its annexation to Oakdale; and <br />WHEREAS, certain property owners located in Section 32 and 33 have <br />also petitioned the Minnesota Municipal Board for detachment of their <br />property from Lake Elmo and its annexation to Oakdale; and <br />WHEREAS, the owners of real property located in Section 32 who have <br />petitioned for the annexation to Oakdale have sanitary sewer capacity <br />available for their use, and have been assessed for construction of the <br />WONE interceptor; and <br />WHEREAS, it is in the best interests of the cities to settle the <br />matter of the entire said Section 32 and to establish a means of permanent <br />cooperation in the event of future problems which may arise in the areas <br />along the border between the cities; and <br />WHEREAS, the cities have other mutual concerns regarding planning, <br />zoning, city services along the common border, environment, development and <br />possible future metro sanitary sewer requirements. <br />NOW THEREFORE, for and in consideration of the foregoing and the <br />covenants and agreements herein contained, the parties hereto do hereby <br />agree as follows: <br />
