1. Within 30 days after signing of the agreement by Lake Elmo and <br />Oakdale, each city shall pass a resolution, in compliance with <br />Minn. Stat. 414.061, Subd. 1., requesting the concurrent detach- <br />ment of that part of Section 32, Township 29 North, Range 21 W., <br />Washington County, Minnesota, lying East of the West Right-of- <br />way line of Inter -state # 694 from Lake Elmo and its annexation <br />to Oakdale, subject to the approval and order of the Minnesota <br />Municipal Board. <br />2. Except for valid petitions currently before the Minnesota Munici- <br />pal Board, all future petitions for detachment and, annexation from <br />property owners in either city shall not be approved unless the <br />following conditions are met: <br />a. All of the property owners requesting detachment and Annex- <br />ation from one city to the other, must initiate the request <br />by a signed and notarized petition. <br />b. Following joint review of the Petition by representatives from <br />both cities, each city must agree, by a majority vote of at <br />least three council members, to the petition. _ <br />c. If either city does not agree to the petition both cities <br />shall pass resolutions that the proposed petition for <br />detachment and annexation is not in the best interests of that <br />city. <br />3. Oakdale is receptive to any request by Lake Elmo to make public <br />water service available, subject only to water capacity available <br />at the time of the request and a reasonable charge for the water. \ <br />4. Pursuant to Minn. Stat. 414.067, the cities request that the <br />Minnesota Municipal Board order the Washington County Treasurer to <br />pay any taxes collected, that were deferred under the "Green <br />Acres" law on land located in said Section 32, to Lake Elmo, if <br />collected prior to December 31, 1993, up to the sum of $3,825.00. <br />Such lands are described in Exhibit "B". Any amounts so collected <br />over $3,825.00 shall be paid to Oakdale. If by December 31, 1993, <br />the full sum of $3,825.00 has not been paid, Oakdale shall pay <br />One-half of the balance due on January 15, 1994, and the balance <br />on January 15, 1995. <br />5. Pursuant to Minn. stat. 414.067, the cities request that the <br />Minnesota Municipal Board order the Washington County treasurer <br />to pay any special assessments collected, that were deferred prior <br />to May 1, 1990 under the "Green Acres" law on land located in said <br />Section 32, to Lake Elmo no matter when it happens. <br />6. If the Minnesota Municipal Board fails to make an order pursuant <br />to Minn. Stat. 414.067, and the Washington County Treasurer fails <br />to voluntarily follow the terms of paragraphs 4. and 5. above <br />stated, Oakdale agrees to act as trustee for the funds received <br />by it and covered by those paragraphs, and to immediately pay over <br />such funds to Lake Elmo. <br />2. <br />
