PROPOSED REVISIONS TO THE RULES AND REGULATIONS <br />OF VALLEY BRANCH WATERSHED DISTRICT <br />SEPTEMBER 24 1990 VERSION <br />SECTION III. DEFINITIONS <br />ADD the following definitions: <br />Subd. 8 Minimum Building Elevation is the elevation of the lowest <br />floor of the building. <br />Subd. 12 Protected Waters are those waters listed in the Minnesota <br />-Department -of--Natural- -Resources'- State -Protected- Waters <br />Inventory, according to Minnesota Statutes Chapter 105.391. <br />RENUMBER the remaining definitions in alphabetical order. <br />SECTION IV. LOCAL GOVERNMENTAL RESPONSIBILITY <br />Subd 3 Standards for Water Management Plans <br />ADD the following section: \ <br />G. The local governmental unit's permitting process for land and <br />wetland alteration work shall be outlined in its plan. Although <br />the District will not be the permitting authority, all land and <br />wetland alteration plans shall be submitted to the District for <br />review and comment. The District reserves the right to appeal <br />approval of a project which the District considers to be <br />inconsistent with the local unit's plan. All zoning changes shall <br />be submitted to the District for review, along with evidence that <br />such a change is in compliance with the local water management <br />plan. <br />SECTION V. FLOOD PLAIN MANAGEMENT <br />Subd. 3 Standards <br />CHANGE part A. 100-year Flood Level Determination to read: <br />(1) Unchanged <br />(2) Major waterways and protected waters -- flood levels shall be <br />determined by the District Engineer. <br />1 <br />01J <br />
