LAKE ELMO CITY COUNCIL MINUTES DECEMBER 1.8, 1990 PAGE 5 <br />( Bohrer indicated this release should be passed by resolution stating <br />that this release is conditioned upon the delivery of proof of payment <br />by the Developer to E&H Earthmovers, the general contractor, for <br />$1.05,762.72. The resolution should be sent to: <br />Mr. Tim Netzell <br />National Title Resources <br />2121 Cliff Drive <br />Eagan, Minnesota 55121. <br />M/S/P Williams/Armstrong - to adopt Resolution 90-40 approving escrow <br />reduction of $105,000 to Robert Engstrom and Willard Morton dba The <br />Forest in Lake Elmo Partnership contingent upon the delivery of proof <br />of payment by the Developer to E&H Farthmovers and to send this <br />resolution to National Title Resources. (Motion carried 4-0). <br />D. Street Light at 39th Street & Highway 5 <br />Larry Bohrer reported he had contacted Ron Hel.fman for NSP to <br />investigate and determine if there would be an installation charge. <br />Helfman said there would not be an installation charge. The only <br />charge would be the usual $10-$13 per month charge for electricity and <br />maintenance. <br />Bohrer recommended a street light be installed at that intersection to <br />enhance safety. <br />M/S/P Hunt/Armstrong - to direct the City Engineer to proceed with <br />installation of a street light at the intersection of 39th Street and <br />TH5 to enhance safety. (Motion carried 4-0). <br />7. CITY ATTORNEY'S REPORT: <br />A. Resolution No. 90-41, Resolution Opposing Oakdale's <br />petition for concurrent detachment/annexation of "islands" <br />in Section 32 & 33. <br />The Council reviewed Resolution No. 90-41 and requested date change to <br />January 30, 1991 on first page, second paragraph, and on second page, <br />last paragraph, change date to December, 1990. <br />M/S/P Armstrong/Hunt - to adopt Resolution 90-41, as amended, A <br />Resolution in Opposition to the City of Oakdale's Request that the <br />Minnesota Municipal Board Initiate a Proceeding to Consider the <br />Concurrent Detachment and Annexation of Certain Property Located <br />Within The City of Lake Elmo. (Motion carried 4--0). <br />8. CITY COUNCIL REPORTS: <br />A. Administrator's Evaluation <br />Mayor Dunn indicated the entire Council had submitted their <br />Administrator's Evaluation forms and they will be referred to the City <br />Administrator. <br />
