Update on Drainage Problem <br />Mike Ziniel, 3265 Kraft Circle <br />At the February 19th meeting, the Council directed the Building <br />Official and Maintenance Foreman to investigate the ponding problem on <br />Mike Ziniel's driveway at 3265 Kraft Circle. Jim McNamara and Dan <br />Olinger visited the site and reported the .ponding of water on Mr. <br />Ziniel's property appeared to be due to a natural low area or <br />depression mainly in the driveway area of this property and the <br />neighboring property to the north. They were not aware of any city <br />related projects in the area that would have caused. the ponding <br />problem. <br />Mike Ziniel indicated it was not his doing that caused. the ponding <br />problem on his property and asked that the City Engineer visit his <br />site so he could talk to him. Because of the budget constraints, the <br />Council made the following motion. <br />M/S/P Williams/Mottaz - to direct the Building Official and <br />Maintenance Foreman to visit Mike Ziniel, 3265 Kraft Circle on <br />Wedndesay morning and report back to the Council at the March 19th <br />Council meeting. (Motion carried 5-0). <br />E. Ordinance proposed by APAC on behalf of Cimarron Park <br />Glen Shoemaker and Floyd Olson, members of APAC, representing Cimarron <br />Park requested the City adopt an ordinance which is intended to <br />provide relocation costs and/or compensation should the Park be closed <br />or converted to another use. <br />APAC provided similar ordinance that were adoptd in Bloomington and <br />Hopkins as well as an opinion from the Attorney General's office and a <br />copy of the legislation enabling a local unit of government to adopt <br />such an ordinance. <br />The Council received a letter fron Dan Krawczyk, Property Manager of <br />Cimarron Park, requesting the city give strong consideration to the <br />proposed ordinance because similar ordinances that were adopted in <br />Bloomington and Hopkins have yet to be tested through the legal <br />process. <br />
