Section V, Subd. 3D. of the District's <br />Rules and Regulations states that: <br />"(2) Alterations which will unnecessarily impact the waters of the <br />District will not be permitted." <br />The City of Lake Elmo should address the feasibility of <br />possible alternatives to this project to show that theproposed <br />diversion is not unnecessarily impacting Sunfish Lake. In addition <br />to the increased flood level impacts, the water quality impacts of <br />the diversion would need to be studied. <br />and: <br />"(3) Alterations not in conformance with the Water Management Plan <br />for the District and State policies will not be permitted." <br />The proposed diversion is not in conformance with the <br />District's Water Management Plan. Therefore, it appears that the <br />plan might have to be amended to include the proposed diversion <br />before such a diversion could be allowed. <br />If the City wishes to pursue this diversion project, the Managers need <br />the above concerns addressed before giving it further consideration. <br />If you have any questions, feel free to contact me at 897-5503. <br />Sincerely, <br />Karen L.
