HILL, INC. <br />PLANNERS ENGINEERS SURVEYORS <br />2500 WEST COUNTY ROAD 42, SUITE 120, BURNSVILLE, MINNESOTA 55337 (612) 890-6044 FAX 890-6244 <br />Lu0'��G_►� u <br />TO: Mayor, City Council, Administrator <br />City of Lake Elmo <br />FROM: Mike Black <br />DATE: April 29, 1991 <br />RE: MUSA LINE AMENDMENT REPORT UPDATE <br />At a special meeting of the Lake Elmo City Council on April 11, 1991, <br />the following motion was made by Councilmember Mottaz, seconded by <br />Mayor Johnson, and upon a vote taken it passed 4 ayes to 0 nays. <br />Councilmember Hunt was not present. <br />A motion to instruct the Planning Commission to hold a public <br />hearing at their earliest possible date, determined by staff when <br />all the work is done to hold such a hearing, for the purpose of <br />considering changing the Comprehensive Plan by extending the MUSA <br />to a maximum of a half -mile east of County Road 19 and a half -mile <br />north of I-94. <br />This direction given to staff by the City Council will require a major <br />amendment to the City's Comprehensive Plan and review by the <br />Metropolitan Council pursuant to Minnesota Statues 473.854 (1982). A <br />major amendment is defined as a change in the Metropolitan Urban Service <br />Area (MUSA Line) involving 40 acres or more. The amendment is subject <br />to a maximum 90 day review by the Metropolitan Council. The primary <br />focus of their review is to determine the amendment's impact on the <br />regional systems - sewers, parks, airports and transportation and its <br />consistency with other chapters of the Metropolitan Development Guide. <br />The Metropolitan Council will require the City of Lake Elmo to modify <br />the proposed Comprehensive Plan Amendment if it is found to have a <br />substantial impact on the Metropolitan system plans. <br />The amendment to the City's Comprehensive Plan must be submitted by <br />Lake Elmo to the Metropolitan Council following action by the Planning <br />Commission and the City Council whose action must be conditional upon <br />completion of the Metropolitan Council review and the Metropolitan <br />Council's determination of regional systems impact. <br />The City Council's direction to study and consider an expansion of the <br />MUSA Line in Lake Elmo is in direct conflict with the following public <br />sewer goal stated in the Comprehensive Plan: <br />* To prevent the extension of public sewer beyond the current <br />limits of the M.U.S.A. <br />
