AMENDMENT <br />This amendment is entered into by and between the <br />Elmo, Ramsey County, and Washington County <br />collectively referred to as the "Counties"), on this <br />day of , 1991. <br />City of Lake <br />(hereafter <br />WHEREAS the Counties have entered into an agreement, dated <br />June 26, 1990 with the City of Lake Elmo and the City of Oakdale <br />for installation of a public water supply to serve residents in <br />the area of the former Lake Jane Landfill; and <br />WHEREAS the anticipated cost for construction of the water <br />system stated in the agreement will exceed the cost stipulated in <br />the agreement; and <br />WHEREAS the Counties have each obtained authorization from <br />their. respective Boards to increase the amount of the contract <br />and adjust individual line item amounts in order to insure <br />completion of the water system; <br />NOW, THEREFORE, the original agreement is hereby amended by <br />inserting the following language in lieu of the existing, <br />identically numbered sections; <br />IV. COUNTIES' OBLIGATIONS <br />A. The Counties will contribute a maximum of $902,796 to <br />the cost of constructing the water supply system, <br />hooking up existing residences to the system, well <br />abandonment and related costs, as more specifically <br />described in the TkDA project manuals dated :larch 1, <br />1991 and April 15, 1991 for completion of the water <br />system and well abandonment. A payment schedule shall <br />be determined, based on the payment schedules required <br />by the bid awards. The amount stated is the capital <br />costs and engineering design estimates provided in the <br />Memorandum dated May 20, 1991 from TDKA Engineers <br />concerning the review of anticipated costs for the <br />project. The actual amount to be paid will be the <br />actual cost of the system as designed in the project <br />manuals and outlined in the TADA Memorandum noted in <br />this paragraph. Ramsey County will pay two-thirds of <br />the actual amount and Washington County will pay <br />one-third of the actual amount, pursuant to the 1980 <br />agreement entitled "Sanitary Landfill Termination <br />Agreement Between Washington County and Ramsey County" <br />B. In consideration for Lake Elmo assuming the <br />responsibility for operation and maintenance of the <br />water supply system, the Counties will make a one-time <br />payment of $25,000 to Lake Elmo to establish a fund for <br />operation, maintenance and replacement purposes.
