OA SECTION June 4, 1991 PLANNING & ZONING I T ,11A : REQUEST FOR A 1ENDMENT TO SIGN ORDINANCE 1Y T ORICiNATIN(Z-' DEP4RTMEN-1 BY: APPROVED FOR AGENDA BY: The letter attached requesting an amendment to our sign ordinance was considered by the Planning Commission at its May•l3th meeting. Although it was pointed out that our code allows for "temporary" or "Seasonal" signs which can be placed on a lot or parcel of land for a period not to exceed 30 days, out of any 12 month period, my opinion is that that ordinance.does not apply to open sales lots. Open sales lots are specifically allowed as an accessory use in the Agricultural zoning district, and as a primary use in the General Business zoning district, On a 6-1-1 vote, the Commission recommends that the Council not change the sign ordinance in the RR zoning district as it would be hard to regulate and unfair to other zoning districts. The Commissioner Voting against this motion felt the request was reasonable to help supplement the taxes on large lots. Staff concurs with .the recommendation of the Planning Commission, adding only that perhaps those residents that wish to sell agricultural or horticultural products should think about starting a "Farmers Market", such as is done in many of our surrounding communities (Stillwater has a•market every Saturday morning in the parking lot of one of its banks). I believe there is more than enough Ag land in Lake Elmo that could accommodate something like this, Getting back to the request before you, I offer the following motion for your consideration: Motion )\4 , Second to deny the request for an amendment to the sign ordinance, based on the recommendation of the Planning Commission, also noting that a change in the sign ordinance would still not allow an open sales lot in the Rural Residential zoning district.
